I was served papers on a so called bad debit back in Feb. 08. Stating that I owe $18,000 plus to Beneficial. Were this Debit come from is unclear to me. I called Messerli & Kramer to talk to them about this I was better off talking to a wall. I tried to tell them that their must be some sort of mistake and should recheck this. The person on the other end told me that I had to put it in writing. Fine ! I mailed them stating the same I even went as far as telling them that I would send them $50.00 per paycheck until this got resolved, and that I was going thru a divorce tat the same time so that was all I would be able to send at the time. By the time I was going to make the 3rd they had gone to court and got a Judgment. I was not even told that this was happening. If I'm being sued aren't I suppose to be notified of the court date so that I can defend my self?

Now they garnished my pay 25% per pay check ! And the 18,000 plus turned into $26,377.21. That hurts when you're a single parent with two minor children trying to rebuild one life again. I tried to arrange payments - I've made payments and they excepted them, they did not say no to them! I really need Help. I have two young children, Don't get any child support, Can't work a 2nd job. Some one help Please.

You cannot call collection agencies or their attorney's and expect any kind of resolution - NEVER CALL OR TRY TO NEGOTIATE WITH THEM.

Agreeing to sending them money at all was the dumbest move you could have made. If the debt was not yours to begin with - why would you agree to send them money? What you did resulted in the garnishment!

All demands in writing - certified mail return receipt requested
