Aurora Loan Services sold my mortgage loan to this company, Midland Bank. I received the letter of transfer on 6/19/05 & mailed out my first payment to them on 6/20/05. They received this payment & cashed my check #109 for $672.06 on 6/27/05. I mailed out my August payment on 7/24/05, check #118 for $672.06 & then my Sept. payment on 8/24/05, check #125 for $672.06. Neither Augusts nor Septembers have been cashed & the payments were mailed in their supplied payment envelope, being pre-addressed to P.O. Box 268888, Ok 73126-8888. I believe they are withholding my payments as to claim I am delinquent, therefore to attempt foreclosure as I am in Chapter 13. Aurora Loan Services did the same thing to me with my payments & my Lawyer proved the accusations correct. Midland does not offer a physical address to mail payments to, as to request a receipt signature via Priority mail. How is it possible that they received & cashed my 1st payent & not the next 2, all mailed to the same exact address? It's not, they are obviously witholding my payments.

Christina!! HELPS ON THE WAY!!!! Use Western Union--JT WHOEVER YOU ARE STICK IT!!!!

I am amazed at how many people don't have a life, like this JP whatever it is from wherever.... Hey dude, if you don't have anything supportive to provide, then totally stick it somewhere's else, stupid!!! We're here to support and help one another, we don't need total fools like you putting in your no sense BS nonsense, fool!!!!!

I just went through the same identical problem and they really socked me up good, but they didn't win! I had documentation coming out of every where, and I buried them in paper!!!! I sent faxes to everybody and their mama and didn't let up!

My mortgage company tried to jack me up saying that same bla, bla, bla. Listen, everybody! It is NO LONGER safe or wise to 1) send in a check, they'll either say they got it late and hit you up for late fees and report you to the credit bureaus or worse, but very real 2) they'll claim that they never received your payments, and ruin the last vestige of your credit. Here's what you MUST DO FROM NOW ON. Find out ASAP if you can send your payments in by Western Union BUT ONLY use Western Union's Quick Payment Service, and you will pay with cash. Ask Western Union for an application to get a discount card with them and whenever you make your payment, they will type in your 10 or 12 digit number and your mortgage company info will come up the same every time. If your mortgage company uses this service (oh, by the way if your mortgage company says they don't use this service, I'd double check with Western Union to see if this is correct. They have a list and can look it up easily), make sure to get all the information such as the city code, state code. If you are able to send it by Quick Pay, before you leave the Western Union Office, look at your receipt copy and make sure your mortgage company's name and your correct account number is on their receipt. Also, check the date and the amount. Always remember to staple the receipt to your copies. I always pay at our Safeway store, so I have them staple the Safeway receipt to the Western Union Receipt. Listen guys, I have really been through it and I learned the hard way. My mortgage company claimed I missed two payments and they tried to foreclose. Luckily, I had saved every stick of documentation. The situation has become so dangerous and ruthless (cut throat) that I have a safe deposit box at the bank with all the original copies of my payments and make copies for my home files for reference.

Also, I highly recommend everyone keep a good filing system on all documentation pertaining to their mortgage lender, etc. All bank statements, every piece of paper their send you, i.e. escrow statements. The reason for this is because I have done some research, and to my horror, what I am finding out is that ever since deregulation, all these low life prime and subprime lenders are getting really fat because their are overtly setting people up to foreclose, and thousands of families are losing their homes everyday, especially people do not have a good command of the English language and don't have little understand of the system or how to get help. The biggest target is single parents, elderly, minorities , lower income or first time buyers, people who have since declared bankruptcy after being with their lender 6 months or more. THIS GROUP IS A MAJOR TARGET for lenders---folks who are in bankruptcy. Their try to slip you up or create situations whereby they claim they didn't receive the payments, then before you know it (it only takes one month, they don't notify you of any problems) and your being hauled into bankruptcy court for a motion to remove your stay. Everyone, beware. It is happening to thousands of people. Always double check your bank statements, religiously every month, NEVER, pay on line, never send in your check or even have it deducted from your account because if something happens, like you get layed off, lose hours at work and forget, your payment will bounce. Y'ALL be very careful and diligent. This really serious, and for many people, can be like a life or death struggle!! I found this out for my self.

Withholding Payments

First off, Midland does not give their physical address on any paperwork and will not give it over the phone; they will stress their PO Box.

Thanks for the physical address from the white pages though, I will be needing that for a future return reciept.

Midland will hold payments in order to make your mortgage go over 60 days so that they can then charge you all sorts of fees and assessments and interest, etc. They are not so customer concerned as they are greedy money grubbers.

They admitted on the phone that they held my payment over 60 days in order to get me "into an arrangement" making it sound like it was for my benefit.

My loan was sold to Midland by Irwin Mortgage, who I had a great 3 year relationship with. They are local and if I was a little late with a payment I could drop it off in the office on my way home from work. How is it they can sell to a company that not only isn't local but doesn't have a satisfactory way to contact them!

The only way I EVER send my payments is via wire transfer from my bank to theirs, and they still held my payment once. I am on top of them and keep copies of everything now.

Midland's address.

Midland does not have a physical address. At least not one they advertise to their clients.

Their letter head reads:

At the bottom of their letters, they read:

Irwin Mortgage sold our loan to this company a couple months ago. We recieved notification along with an form to continue our automatic draft payments with them. I filled out the form and mailed it in. We received a letter from them yesterday (Dec 7th) that is dated Nov 22!? They said that we have failed to send in the form and must mail them a check by the 15th to avoid the late payment charges. The letter is obviously off a copy machine and the P.O. Box seemed shady to me, so I checked this site.

I've not been screwed yet, but it looks like it might be possible.

Midland does have a physical mail address. If you knew anything about Chapter 13 you would know your protections as a consumer. All government mortgage servicers are audited for compliance on a regular basis and there is no way they could get away with this type of practice. Do your homework !!!
