BUYER BEWARE OF MIDWAY CHEVROLET!! MUST READ THIS BEFORE YOU GO THERE AND BUY A CAR. I DID ALL THE RIGHT THINGS AND THEY STILL GOT ME SO YOU CAN NEVER BE TOO CONSIOUS

On November 23rd, 2008 I went to Midway Chevrolet in Phoenix, approximately 40 miles from my home in Gilbert, because the salesman Scott Collins called me about 5-6 times that week to see if I would come take a look at a great deal they had for a convertible car for $12,900.00 minus the $ 500.00 internet coupon because that is how I found them. So the base price of this car was $12,400.00.

I was there for at least three hours going back and forth about prices and what they would give me for my trade.

They played this game about the financing and told me they couldn't get me financed on my own and asked if my mom would co-sign. So I asked her, and she said yes. They said that was good, because now the interest rate would be much lower and my payments would stay down as well.

I wanted a newer car for the same amount of a payment that I was paying for my Lexus SUV. They said they would give me $7275.00 for my trade, the lowest end of Kelly Blue book value. I owed $13,200.00 on my trade so they could add on the difference of my trade of $5925.00. So the total amount financed would be $18,325.00. On a used 2008 Sebring convertible and I would never be upside down by buying this car, now that we agreed on a price, they told me to take the car and drive to get my mom. So I did.

When I came back and we sat with the finance guy, now all in the sudden it is in my Moms name not both of us. I believe that was so that I couldn't see what she was signing, because it isn't what I agreed to, those numbers changed on that contract. These numbers were as follows: a selling price of $13,995.00 and only $5500.00 for my trade and they had me buy a Lo jack system that they advertised for free with a purchase of a vehicle from them. They had me purchase a warranty for $1500.00 for bumper to bumper coverage that supposedly covered everything including the Lo jack that should have been free in the first place. The total amount on this was $356.00 per month, they said that's not bad you have a new car for only $6.00 a month more with a 7% interest rate. The total amount actually financed on this contract was $21,946.97. That is a $3621.97 difference from what we had agreed to before I went to get my mom. I didn't know what to do at that point so I called Scott Collins again, and he never returned my call.
Then on Tuesday November 25, 2008, Scott Collins called me and said that they had missed something that my mom needed to sign. That it was a formality and no big deal. I was upset because he wanted me to drive there and I said no. Why don't you mail it? He said no big deal, I will come to your house. I figured we could discuss the difference in price and get it fixed. It was also at that point he promised that he ripped up my down payment checks. When I was trying to keep the dog from attacking him he had mom sign a piece of paper that he stated had to do with the warranty coverage, and if she didn't sign it, we wouldn't be covered. When she looked at it that is what it said. He also stated that we should receive the coverage booklet in the mail within two weeks. It is now January 29, 2008 and I have yet to see it. They also never installed the Lo jack and they said they did.
This isn't the worst of it yet.

I received my payment book and low and behold it was a different bank and my payment is now $480.00, I guess they didn't think I would notice the increase of $124.00 per month. A payment that I clearly cannot make on my income. I called Scott Collins again and said what is going on why is my payment so high, he said I don't know, I am going to have to find out for you and get right back to you.

Well he never did, I called him insistently every day. I went up there on Christmas Eve to find out why, because he stopped taking my calls he pretended to not be able to hear me when I called his cell phone from a private number. When I went up there to confront him I asked him why he was avoiding my calls, he said he wasn't. I started to cry and said you need to fix this because I cannot afford this payment. He must have felt somewhat bad about what he did, because he said maybe there is a way to get you out of this contract.

The General Manager Mark Ruhl came over and said let me take a look at the payment book and the paper work you have. I gave it to him waited about 20 minuets and he came back with all of it except my contract. They refused, flat out refused, to give it back to me. I should have called the police. My eleven year old daughter was with me and it was Christmas Eve, I didn't want to spoil her night anymore than I already had. My husband was killed less than a year ago, so it was tough enough as it was during the holidays.

I called the bank on Monday December 29th and spoke with Gary who told me that my total financed amount was $28,108.00 and the interest rate is 11%, my interest over seven years (Scott told me it would be a 5 year loan) will be $12, 999.00, so now I am paying more in interest than I was suppose to pay for the car; For a total of $41,107.00. On top of everything else they took a down payment from me that they were supposed to rip up, and instead they cashed them and they bounced. I stopped payment after that but that cost me another $105.00 in fees plus $29.00 to stop payment, Mark the General Manager said they would reimburse me for that, I have yet to see that too. So add the $1500.00 into the total because if it the checks cleared it would have been another $1500.00 they got, and now I am up to $42,607.00 with interest. On a SEBRING, I was driving a Lexus! I could by a 2007 Convertible BMW for $43,000.00!!

Mark told me to call him and he gave me his card with a cell that he wrote on it. The cell number that he gave me has a generic voice mail box and you cannot even leave a message. I believe that they all (the salesman) change their cell numbers, all the time so that when they rip people off they cannot be reached unless you go there. I was a perfect target because I am 40 miles away.

I spoke with mark about six times one night then he Said he had a family emergency his Daughters cat was lost and he promised to take care of this and call me in the morning, I promise he said. I have that recorded and when I said that it is well over $7000.00 they owe me, he said let me call you in the morning. I am still waiting for that call to come. He at one point (when I was there on December 24th), asked me if this was all of Scotts doing, and to be honest with him, I thought he was going to fire him, maybe he did, I am sure he saw how badly I was ripped off, and got very nervous, and that is why he stole the contract from me. I do have however, a copy of the original Mandatory disclosure that has all of the original totals listed on it, along with everything else. I have no contract dated November 25th like the bank does. The bank's copy is not the same contract my mother signed on November 23rd. We do not even have a copy of ANY contract at all.

I have been told to contact the Attorney General's office and the BBB, I am in jeopardy of losing this car because I cannot make these payments and this will destroy 65 years of my mom's good credit because she was trying to help me. I tried to see if the bank could do anything because they lied to them also. They have actually been very nice to me.

I have tried to work this out with them, and they said they would fix it and they haven't. I have been unable to find the Owner of Midway Chevrolet.
I have also e-mailed Mark Ruhl with this same information and he did not reply to that either.
They should not get away with this.

P.S. since I wrote this letter they now have the nerve to go after me (with a collections agent)for the $1500.00, that I stopped payment on and they were not supposed to be deposited in the first place. They stop at nothing.

Let's talk about the fraudulent documents that went from the dealer to the bank

I seen the customers credit application she filled out in her own penmanship. It stated she only made it $1200 a month. That was what she the lady's name Rebecca wrote on the credit application she cemented to the dealership. I've seen all the documents related to this deal. I also seen a copy of what was submitted from the dealer to the bank. I'm sure people at the dealership knowJackie Yocus very well. She was a fraud investigator at the time. After Jacqui sent a copy of the dealer track data That went from the dealer to the bank Over to the customer that document the customer never seen nor did she ever sign it or did she ever fill it out

That document said to the bank the customer made $5000 a month. The customer had excellent credit. Just not enough income to buy that car and somebody not the customer lied to the bank. That's why the bank requested that the dealership buyback the loan. Jackie at Huntington national Bank told me she did not want fraudulent loans on her books

So if you are a customer a car buyer contact your lender and ask for copy of the credit application data they received from the dealer. Also when you buy a new car or a used car make sure you get a copy of the credit application before you leave. If you do not get a copy of the credit application that you filled out with your personal data on it refuse to buy the car

I was the one that personally exposed what data the bank had in their possession that the customer never seen or filled out. None of this would have ever been exposed at the dealership given the customer a copy of the warranty agreement that they will customer agreed to. Rebecca asked several times for a copy of the warranty contract which nobody would give her. No I did the bank Jackie from Huntington national Bank the fraud investigator know that the customer and the bank financed a LoJack at $1190 and an extended warranty because it was buried in the contract.

There was not full disclosure to the lender. On the dealers behalf. Somebody at the dealership never told Jackie or Huntington national Bank that they had sold an extended warranty and a LoJack to the customer. Everything that is financed by auto lending company has to be revealed has to be itemized. Maybe a copy of the credit application and the dealer track info needs to be posted on the ripoff report to bring out the real truth

 I remember this very well. Unfortunely our stories differ quite a bit.

The day she came into the dealership, it was a very difficult deal. Based upon circumstances, she most definetly needed a co-signer and a bit of cash down.

Initially when we submitted the deal we tried to get a low rate, but based upon the circumstances the rate went up. I called to let the customer know this by letting her talk to the finance Person. I did not want to drive completely out to Gilbert unless
both parties knew the exact numbers. I just do not show up to someones door-steps and say oh by the way, your payment is $124 dollars differant. The finance person went over the numbers and she agreed to them. I was there when he called.

When I did go to Gilbert, the customer did not want her Mother to know she was putting A downpayment down, why that was I am not sure. She ushered me into the bathroom and made me promise not to mention anything about the downpament, and proceded to write the checks.

I met her mother outside, showed her the new contract with the official approval, payments, Intrest, a.p.r  ect. She went over the contract, saw that the numbers were exactly what the finance manager went over with her on the phone. then proceded to sign them. It is very doubful that a mature adult and daughter would sign a contract and without going over it and seeing the numbers that are cleary marked. There were no blind folds.

I am not sure why the customer is having so much trouble, especially since she knew all along the payments were going up and we were able to extend the term to 72 months to keep her payments from going up further.

The customer did make a appearance at the dealership, I remember that vividly. She told  me she could not make due on the downpayment and needed more time, I did feel sorry for her because it was Christmas Eve. I told her I would do what I could. I talked to management and they told me 3 weeks was the agreed upon time for her downpayment, and based upon the
fact that we use a 3rd party guaruntee company the checks would have to be dropped. I told the customer this and she did break down and cry. I gave her a Hug based upon compassion, and told her how sorry I was. Which I was. I even offered to give some some money if it would help her out. Not alot, just $100 bucks. No strings attached. Just me being humane. She
declined.

The customer continued to call making threats screaming and yelling loudly thru the phone  She explained that she could no longer do the downpayment.. She called me 8 to 7 times daily getting more and more agressive with her tone, at that point, I got our customer service director involved and stopped accepting her calls. Her issues seemed to me to be well beyond the 
purchase of a car. She told me her Husband had been murdered and she was having trouble with with work and her Mother and a whole host of other issues.
  
I have been selling cars as a professional for 18 years. 80% of what I do is based upon referrals and my good name and customer service. I sell 20 to 25 cars per month, consistantly. You can only do that in business by doing business the right way. For all my success, I can count the  complaints on one hand.  Unfortunetly, this is one of them.
   
That is what I remember about this unfortunate transaction.

Huntington Bank is presently in the process of "possibly" doing the right thing and not allowing Midway Chevrolet to get away with banking fraud. I hope that they decide to retract the loan that was obtained from Midway using a false credit application.

Midway submitted this credit application over and over to different banks until they found one that approved it, using false information to do so.

The state of Arizona should not allow anyone to take posession of a car that was not approved by a bank on the spot. Did you know that you can actually drive a car home without owning it and the dealership just keeps sending your credit application to every bank they can until it gets approved? Then your interest rate sky rockets and so does your payments, while the entire time you were lead to believe that the loan was approved before you left the dealership, when in fact it was not.

I want to warn anyone out there to ask for a copy of your credit application, and a copy of the approval from the bank with your trade in value and the exact amount of the purchase price, payment and interest rate. If the dealership can not give you that before you leave DONT TAKE THE CAR HOME!!!! Keep and make copies of "EVERYTHING"!!!
If you feel like this has already happend then you need to contact the bank and get a copy of this sent to you immediatly.
Someone has to put an end to these dealerships that ripoff everyday people, rich, poor, elderly and middle class.

Thanks to consumer advocate, Stick Bogart, at Rip-off Report these liars and thieves were exposed for the scum they truly are!

Stay away from Midway Chevrolet and Scott Collins, Mark Ruhl, David Pierce, and anyone that may be the finance department manager at the time of the sale. Better yet. do not go there at all!!

I am keeping my fingers crossed that Huntington will do the right thing. I am sure there are many more loans done for them using false information. I can't be the only one out there!

This banking fraud is going to be exposed on a local TV station and an on camera interview with me, in the next week or so. I already finished one on camera interview.

Thanks to the Consumer Advocates at RipoffReport.com, I now have the absolute solid proof that there was banking fraud that has taken place in my situation.

They helped me to obtain the paper work that I needed to prove my case in a court of law.
After obtaining the paper work from the bank I finally have the correct amount of what Midway ripped me off and the total amount was $11,609.00, and a 3% increase on the interest rate.

Huntington National Bank (Huntington.com) was given a fraudulent credit application and was lied to by Midway Chevrolet on Bell Road in Phoenix Arizona.

At this point I am hoping that Midway Chevrolet will take the proper steps to fire the person who committed this fraudulent act.

Midway Chevrolet will also need to make things right in order for me not to take any legal action against them for banking fraud and I will make sure that the Arizona banking commission has all of my documents. I will not stop until they make this right.

Now the Attorney generals office and the Better Business Bureau all have these documents as well.
I strongly encourage anyone that buys a vehicle to call the lender and ask for their credit application.

I have been speaking with Huntington Bank and they are going to review all the other deals that come in to them from Midway Chevrolet for more fraud.

The Automotive industry is now doing to consumers what the mortgage industry did when they got people in way over their heads with payments that they clearly cannot afford, are they going to just look the other way and allow this to happen to everyday hard working people?
I will make sure that my story gets out to everyone that purchases a vehicle.

I did all the right things and read what I signed and took the proper measures and they still got me. I am sending all of the documents that I now have in my possession to Cecil & Larry VanTile to show them the crooks they have working for them. If they are decent business men they will make this right, or I will make it my mission in life to have them end up like Bill Heard Chevrolet in the end, if this is how they want to do business.

I plan on making sure that anyone that plans on going there to buy a car will have to stop and talk to me first and they will also be given copies of the Ripoff Report along with all of the fraudulent credit applications. If I have to I will do this on their busiest days starting this weekend and every weekend after that, and they will certainly loose more than the $11,609.00 they ripped me off.

MIDWAY I PROMISE I AM NOT GOING AWAY! IF YOU WANT THE PROOF THAT I HAVE THE PAPER WORK I NEEDED, I WILL BE HAPPY TO FAX IT THIS TIME. WONT MAKE THE SAME MISTAKE TWICE, TRUST ME!!!!

E-service the company that Midway sent me to for collections spoke with me. The General Manager of this collection agency told me he had the original contract dated the 23rd of November and that he would send me a copy of it. Obviously Midway made a mistake and sent him the wrong contract (the original that Midway stole from me). He said it was my right to have a copy of that and that it was clearly dated November 23rd not the 25th. Well he had to have called Midway because he sent me the one from the 25th. I thought he was going to help me. Midway must have paid him off and faxed the FORGED contract to him. Not one person is honest and it makes me sick!
