I have a son who was an 'A' student in high school, an athlete and a coach and tutor to younger kids. He went away to college and one week-end when he was home during his freshman year he got arrested - for being a foolish teenager - and a mug shot was taken of him at the county jail. Over the last 2.5 years we have been after him for not getting a job. Tonight I decide to google his name just to see what I find.
The second listing on google search was mugshots.com and this one misdemeanor arrest that took place 2.5 years ago. The incident was expunged so I was shocked to find this when I did my google search. I decided to dig deeper and it appears many, many innocent people or those who made a minor foolish mistake at some point in their lives are finding their lives destroyted by websites like mugshots.com and unpublisharrest.com. I also found there appears to be several class action suits against these companies.
If you go to www.mugshots.com and click on a link to find out how to 'unpublish' a mug shot, you are directed that you may submit a request to have your mugshot unpublished by using one of mugshot.com's 'authorized vendors' which happens to be only unpublisharrest.com. Supposedly for $399 you can pay their 'authorized vendor' to have your mugshot 'magically removed.' This is unethical, extortion, racketeering, ponzi scheme - I am not sure what all to call this, but at the very core, it is immoral and unconcsionable. We need to work to get these types of businesses shut down.

Chase Johnson is a Criminal
AUTHOR: victim2012 - (United States of America)
SUBMITTED: Monday, November 19, 2012
Anyone who posts a rebuttal on this website in defense of Chase Johnson is the criminal himself or one affliated with him. There is no person who would thank him, or extol his praises after being extorted and victimized! This individual is a bottom dweller, and criminal himself who has been exposed as well as his counsel website owner and will be brought down legally.
I was posted on this website for a false arrest. These companies siphon data bases from local Sherriff's departments who only post these photos for ususally only a few days. This is not a service. No mugshot would come up in an internet search were these scammers, internet frauds and their cohorts using dubious means to harass, defame, exploit, terrorize and perpetrate crime against people who are likely innocent. Even the few indviduals who have done wrong, unless they are a danger to society and for some reason not incarcerated, this is no "service", as these people have paid dearly for their mistakes.
My personal experience with this individual entaied my asking him to remove my picture, and explaining why. I was firm but professional, and since he didn't like the truth being pointed out, he told me to f*** off, hung up on me, then told me my results will be easier to find now.
They are number 1 on Google, who is NOT innocent in this scam, Google controls what is on their search engine, and since this individual advertises he gets domain authority. I am a professional, Mother and known individual with friends and family who actually commited NO CRIME, and though the matter of my "arrest" was resolved, and entities responsible have been dealt with, this individual still insists to use what he believes is public record, and his legal right to continue to post this for $400, and now personal averice. This individual is a psychpath.
If noone pays him, he will be out of business. Do not pay him, or any reputation management company as they are all affiliated. Sue Sue Sue, and Sue again. Report him to your legislature and authorities, make him and entities like his such a thorn in the side of all the aforementioned, as well as call hiom, his lawyer, the website owner create a public outcry. It is sick that this can exist, and if you pay you are perpetuation this person who sits in his house in Florida ruining peoples reputations, business' and lives. Not all people who are arrested are in facet criminals, and public shamming is archaic and criminal.
If you are a lawyer and want to make a name for yourself not defending what may be deemed as criminals who deserve this, but rather innocent people with a mistaken arrest or perhaps a minor misdemeanor which has now been eternalized and will ruin their lives!

Attorneys on Avvo have made the comments below. Would they have made these comments if it was them or their children on Mugshots.com? I don't think so!
"The mugshot is public information. Anyone could have looked it up as soon as the government publicized it. It could have been printed in the paper or broadcast on tv. A radio announcer could have described it."
"Mugshots are public records of the actions of the government. It is lawful everywhere in the U.S., so far as I know, to publish documents and photographs that are public records of the actions of the government. People are apoplectic about the existence of these mugshot sites but they are an unfortunately humiliating byproduct of open government and the First Amendment. "
"When the police book you and take your photo after your arrest, that photo is a governmental document. We live in a democratic country where most governmental documents are not secret and anyone can obtain a copy. "
"Unfortunately, it is public record. There are services where you can pay for removal for a fee. There is not much you can do because it is public record and you were arrested."
"Sorry, but the pictures are public record and they can be posted online. We have had a half-dozen or more questions asking this very same question. The answer is the same and the answer is that this is totally legal. If you want to stop this you will have to change the law in your state. Until then, as long as the pictures are public record there is little you can do."
"it appears to be legal. One way to view it is via 1st Amendment protections that would apply to a newspaper or radio station. In our small community, every non-juvenile arrest goes to the 8:00 AM radio and in the newspapes. Some news stories include the mug shot."
"the website is within its rights to post the mugshot"
"MugShots.com and other mug shot display websites base their existence on the rule that mug shots are public, official records, and that a citizen does not have a state law privacy interest in them. Further, under the First Amendment, most official, public records can be obtained with permission, third-party release, or proper request under the Freedom of Information Act (FOIA), if they are not already publicly-available documents to begin with.
If the official mug shot is part of an arrest record, the mug shot could be considered part of the public domain in some jurisdictions. Even if a mug shot is not officially considered part of an arrest record, it is generally a photographic record in the public domain and the laws of most jurisdictions allow one to request and obtain these types of records.
Some states recognize a common law right to privacy, and the Appeals Courts are split on whether or not a citizen who is arrested (and of course, presumed innocent until proven guilty) would be entitled to demand that their mug shots be removed from websites if they are later acquitted.
MugShots.com, in particular, offers a courtesy removal process in certain instances, although they vehemently protect these options as a mere courtesy, and not a legal requirement."

We can't blame Chase, or Unpublish Arrests for the mugshots being on the internet for all to see. I had some unfortunate circumstances lead to 5 arrests when I was 19 years old in Florida. I was never convicted of anything, and have led the ultra clean life since then. I wasn't into drugs, I wasn't violent, I was just a victim of running with a crowd who put me in bad situations. I thought I was invincible, now as an adult, with a wife, and a child on the way its all affecting my career.
While Mugshots.com is deplorable, providing a fake civic service. The people at Unpublish Arrests are there to help us, when I explained to Chase what happened, and how it was keeping me from getting Jobs that I was qualified for he jumped up to help. He truly cares about his clients, and I would honestly recommend them to anyone. I mean honestly, if you have to spend the money to get your mugshot off of the first page of google, its money well spent. Because a n expungement would cost thousands.
Thanks Chase!

BOISE The Ada County sheriff says its own website is being used to extort money from people who have been arrested. Since 2003, the Ada County Sheriffs Office has been posting daily mugshots of those arrested on their website. But, Sheriff Gary Raney says recently third party websites have been "scraping" the mugshot and names of those on their website and then placing the information on their own website. Scraping websites, like Boisemugshots.com, has thousands of mugshots of those arrested since early 2011.
The photos on Ada Countys website are deleted after five days. Boisemugshots.com provides a link to another site that removes the information from the Internet for $99. It's really a form of extortion, said Raney. This is something that really goes against the fundamentals of what I sense we should be putting that mugshot out there for. Raney says he is now considering taking down the website to protect those who have been arrested. There's really an injustice that happens to people, said Raney. Raney is also looking into increasing the security on the site to prevent other sites from taking information.

This is EXTORTION, I want $1million for use of my image
AUTHOR: ChevetteValentine - (United States of America)
SUBMITTED: Thursday, October 25, 2012
Disclaimer: I did not release or give consent for the use of my images and I am seeking an attorney to file suit for damages!!!!
I was in class today and we did a project where we had to look into our images and stories on the internet when I found this photograph. I was appalled. Immediately I called the number posted 800-276-2540 and got a guy named Chase Johnson, who told me for $399.00 I could have my image removed, this is EXTORTION, though theses are public records you have no right to post this information, charges were dropped and I was released.
The arrest was when I was an employee for New Birth Missionary Baptist Church, for Bishop Eddie L Long and after "REFUSING" sexual and other inappropriate advances I was arrested at Church and charged with Trespass, after much pressure from the Church I was released. He was later charged with sexual misconduct against several young men.
I thank GOD I recorded this call, this "jerk Chase Johnson, tells me that he was offended that I called, the nerve of this jerk. This is professional EXTORTION, to have to pay to have inaccurate information removed is illegal and a violation of my civil rights. I further investigated and found this site, where another person has also charged the same.
This is nothing but an sophisticated SCAM!
I also found there appears to be several class action suits against these companies.

Another Perspective...
AUTHOR: Tumbleweed5598 - (United States of America)
SUBMITTED: Friday, October 05, 2012
Although it's unpleasant, it's also a reality that those of us who have ever been arrested are fair game to have our public records be just that...public. However, it was a relief that even though I was shocked and unhappy to find one day that my arrest info from long ago was posted on the internet, at least there was a way and remedy to remove it. I contacted Chase at Unpublisharrest.com and I was treated very kindly and professionally and he explained to me in detail how the unpublishing process works.
Within 2 hours my record on mugshots.com was taken down, and within 1 week the whole link was removed from Google. It is what it is ...and the amount I paid to have all that removed was small in comparison to the peace of mind I now have that my mistakes of my past are not plastered all over the internet. It is not Chase's fault that i ended up in public records in the first place... it is my own fault and I must keep in mind I live in a country where public records are just that... public. I look at this from a different perspective... at least I had the option and choice to contact someone who had the ability to take down my arrest record. And his company did just that. Thanks...
