In August 2013, Felicia, owner and operator of Nail Sauce, advertised and accepted preorders for various nail polishes selling for around $9.00 a piece. According to her site these preordered items would be shipping within 1-2 weeks.
After waiting over 3 weeks, Felicia posted on Instagram that her cap supplier sent her the wrong bottle caps and that she was having problems with the USPS locating her replacement caps. There were dozens of responses to her post with people asking for updates on their orders. At this time she replied to those questions giving answers. Two weeks later she replied saying that the caps were in her posession and that orders would be shippied within a week.
Four weeks later, Felicia posted another Instagram post thanking people for their patience saying that she had started to process their orders. Two weeks after this post was made customers began to ask for order updates. Many were upset and frustrated with the length of time they had waited and with the lack of communication on Felicia's part. Felicia did not respond. There was some speculation that Felicia posted the second update to try to prevent people from filing a claim with PayPal since the 45 day complaint deadline was coming up close. I don't know if this was indeed the case but I do know that the email I sent to her was not answered by her until the day before my 45 days were up. In her email she said my order would ship within a week which is why I didn't file a complaint. In the coming weeks customers continued to post messages and questions to Felicia asking for updates or refunds. There was no response from Felicia.
On October 17, Felicia posted a third update on Instagram. This time instead of offerring an update or explanation for this ridiculous delay she played victim lashing out at customers for harrasing and "attacking" her. Nothing was mentioned about orders being filled. She did promise refunds to those who had requested one. However, to the best of my knowledge no refunds have been made. I asked for one over a month ago and never got a response.
It is important to note that during this time Felicia never made a real effort to reach out to her paying customers to inform them of the delays. Instead of proactively emailing those that had ordered, she posted on Instagram sporatically which only served those customers on Instagram that are her active followers.
She has stopped responding to customers. Since the 45 day PayPal complaint deadline has passed there is no way to file a complaint. I have since contacted the USPS to file mail fraud charges (which applies to internet commerce) as well as the California Department of Consumer Affairs since Felicia operates her business in that state. I will be moving forward with complaints unless Felicia delivers product or refunds within the next 14 days.
While I understand Felicia is a person, with a life, she is also a businesswoman. If you can't act professionally and provide your customers with basic customer service then you have no business operating an online store. It is not unreasonable for customers to expect the products they paid for in the time frame promised to them. What is unreasonable is to accept payment for products and not send them then ignore your customers and keep their money. That's called stealing and that's illegal!
