National City has many unfair and unethical practices which lead to robbing their customers with unfair overdraft fees. First of all, they deduct from your balance immediately for any pending charges and/or checks (even before they have sent the money). Next, they hold deposited money until the next day, even though they have the check in hand. While I understand that this deposit process is similar to most banks, it alone is an unfair practice.
Beyond the facts stated above, National City has programmed their processing system to take the smallest charges last, therefore creating the highest number of overdraft fees as possible.
I recently had an insurance company take out money sooner then they were supposed to which led to my discovery of these unfair practices. As soon as I saw the transaction was pending I went in and made a deposit. That evening when they processed everything they took out the large charges first, then all the small ones, and then processed my deposit (but before doing that they took out 5 overdraft charges for my 5 smallest transactions that took me into a negative balance). When I tried to contact the bank to request that they only charge me one overdraft fee they denied my request.
Their programming method ROBS National City customers and is 100% unfair and unethical, and when I'm done I hope it will be illegal as well. Since they were not willing to work with me on this I will handle it another way.

Hey Employee-Explain This

If it is legal to post from largest to smallest, then explain how your company has lost the class action lawsuit regarding re-sequencing debits to cause extra overdraft fees.
PNC, who bought National City Bank on November 6, 2009, has been ordered to $12 million to a "settlement fund".
Anyone who held an account for any amount of time between July 1, 2004 through August 15, 2010 should have received a card in their mail by now about getting their part of this settlement.
MDL No. 2036
"In re Checking Account Overdraft Litigation"
Future court date: July 15, 2011 - for approval of the settlement by the U.S. District Court in Portland, OR

I understand how you feel about your OD situation; however, please keep in mind that it still isn't an error on the bank's part. I can write you a book explaining why, but you would still not understand. I think the right thing to do would have been to refund some of your money because people do make mistakes. Remember the reps you speak with do not have full control over what can be refunded. We also look at previous OD/NSF history when making these decisions. Oh and I would never call you a liar even if I thought you were off the phone. I'm not that type of a person. At the time when National City was still operrating as a bank, their deposit and when funds would be available was clearly written in the agreement which was given to you when you opened your acct and one mailed to you when changes were made to this policy. I hope you are happy with your new bank.

Read your account agreement.

First of all, The reason I post here is to help customer of NC understand how banks work, so that in the end they can avoid paying these fees.
So here we go. Items do post largest to smallest. And the reason is simple. You have a 1000$ mortgage payment or 10 5$ charges to some fast food joint. If the mortgage payment is held to the very end, it could be returned, causing you a late fee(usually 40$ from most banks) and can get you a negative report on your credit history(lasts 7 yrs). As for your deposit, it is the first thing to process on your account. If it comes from outside of ncc, then it is deferred to the next business day so we can verify it is a good check.
U'd be suprised how many bad checks or empty envelopes come through the bank each day. Its seems your problem is that you "floated" some items, and because it didnt work out as you planned you have this arguement. I am sorry to say, it is ultimately your job as a consumer to keep track of your account.

Banks can hold deposits up to ten days until they clear. A check means nothing until it is funded. Don't write checks until your deposits have cleared. Pending a transaction is very normal. Banks will usually only clear checks immediately if you have the funds to support it should it not be honored. This is typically done through a savings or money market account. You should also consider having a overdraft protection account, or a link to another account just in case.

Check 21 Act
AUTHOR: Scott - (U.S.A.)
SUBMITTED: Thursday, March 16, 2006
Since the passage of the Check 21 Act, it is possible for checks to clear the same day they are written. That makes it all the more important you not write checks if the money is not in the account.
The days of hoping a check will not clear before a deposit is made are past us. Switching banks is not the answer. Most major banks are now using this system and is being implemented by more banks all the time.
So, do not write a check at any time if you will show a negative balance in your check register.

Change Banks

I used to bank with NatCity until they screwed me over too. I had paid some bills on a thursday evening being paid the next day (I paid them AFTER 5PM) and a check cleared that night at midnight, so they said I was in overdraft twice ($68). I called them up and was handled rudely by some little turd named Syed Ali and then told by his supervisor that there was nothing she could do either, despite his complete and utter rudeness. To top it off he was on the line the entire time, I discovered as the call ended... I heard him say, "You're a liar." I am no skizzo or anything, I don't ever get paranoid, I just get upset. The next day I marched my happy butt into the bank closed the accounts (1 savings and 1 checking) and moved them to BankOne (now J.P. Morgan Chase) and have been happy ever since.
So my advice, drop 'em like the turds they are.
