I recieved a call from Nelson Watson and Associates mid April about an attempt to collect a debt. They told me I had 14 days to pay $2,900 on a Yamaha account that was bought out by Resurgent Capital Services.

They said I would be taken to court if I didn't pay at that time. Feeling pressured I told them I would call them back later that day to see what I could do. I had not a dime in my checking account and my next paycheck was already deligated to rent, my car payment... thats it. That's all I make.

I called them back and said I could swing $400 that last Friday in April and another $1,000 on May 9th as my stimulus check was coming. I filed through Turbo Tax... Nelson Watson and Associates assured me that if I went through turbo tax that I would have a direct deposit.

Needless to say, Turbo Tax doesn't do direct deposits, my transmission blew on my car and I had to do something. They told me that I had to have the full amount paid by July 15th. no later or Resurgent Capital Services will take me to court.

I set up another payment arrangement. It was pulling teeth, and they were very rude to me. A manager there told me that Capital Resurgent Services take people to court all the time. They don't care what financial situation your in. Then you get stuck with all the court fees.

May 20th, I called a credit counselor. THey gave me information on the fair debt collection act. THey also told me that only 25% to 30% of your income can be garnished. SO I'm thinking... the payment arrangment that I was forced into by Nelson Watson and Associates was half of my monthly income each month! I couldn't do it. I would fall deliquent even more. I sacrificed my rent in April to pay them.

SO I called them back. This is where I was shocked. A female manager gets on the phone with me.. After going back and forth I got my payment lowered each month. THen I kindly asked if she could get back on the phone with her client to see if I could make it just $50 lower.

This female manager then got very unprofessional and extremely volatile. She said.. "I'm getting tired of being on the phone with you....I should just drop this payment arrangment all together and make the total due $2,500". She then said "No.. I'm not getting back on the phone with them..." I asked her again.. SHe said "No, I am not going to do it".

I felt violated. I was so upset because Nelson Watson and Associates specifically told me that I wouldn't be able to reach Resurgent Capital Services. Nelson Watson stated that if I tried calling Resurgent, I would get automatically transferred to them.

After I gathered my thoughts I told her that it was my right for her to contact them. I started to say something about the Fair Debt Collection's act and she interupted me. She said "Don't you tell me about laws you don't understand".

She then said.."YOu want me to call them? I will.. but the answer is going to be no".. I have a feeling she never even contacted Resurgent Capital Services as she got back and said "they didn't agree" or to some extent of that no.

Since then.. I contacted Resurgent Capital Services and filed reported them. WHen I called Resurgent Captial Services the customer service/collection rep said that Nelson Watson and Associates was a law firm that works with them!!!!!!!! I told him.. Nelson Watson and Associates is not a law firm! Isn't that illegal for a collection agency to make themselves out to be a lawfirm?

I really need help with this. I don't knwo what to do. I wish I could lower my payments... but I can't and I'm going to be in the hole even more. Please help. SOrry this is so long.
