We contracted for a $36,058 low-end, 2-bedroom manufactured home to place on a 2-acre tract we own free-and-clear near a large Oklahoma lake. We left $1,000 earnest money and asked the dealer to contact his contractors and get a price for connecting the home to the existing utilities. The property has a well, a septic tank, and electricity onsite--the property had a double-wide manufactured home on it which was removed prior to us purchasing the lot. All utilities are in-place and ready to connect.

We asked the dealer to find a bank which would finance the balance of $35,058 over 5 years at no more than 8% interest. This dealer applied for a loan on our behalf of $70,656.14 (without our authorization) and contacted us saying the "loan had been approved." When we questioned the difference between the $35,038 purchase price of the home and the $70,656.14, the dealer attempted to explain he had gone ahead (without our permission) and financed $19,000 for connecting the utilities (which are already in place) and the loan would have $16,000 "closing fees."

The loan which the dealer applied for in our name, without authorization, was $70,656.14, with payments over 23 years at an interest rate of almost 10%. Because the lender (without our authorization) pulled a "hard" credit report at the request of the dealer, our credit scores have temporarily decreased, leaving us with less negotiating power with his competitors. We contacted the dealer, rescinding our offer to buy this home, due to his illegal fraudulent dealings with us, and the dealer is refusing to return the $1,000 earnest money.
