I had just re-financed and have made 3 payments which went to the original loan co. Without any notice of selling my loan or anyone buying my loan I started to receive letters and phone calls from a company named "Ocwen".
After some research I found out my loan was sold to Ocwen on June 1st, 2002. I thought this was strange I was receiving collections notices, and had only made 3 payments which are all current.
After several weeks now, actually the 5 weeks that they have owned the loan, I have been battling with them every day.
I have acuquired the funds to pay off my loan, requested a payoff quote ( which is 10.00 ) in the payoff quote are bogus dates, amounts, an already expired grace period date, and the TOTAL amount due.
After all the bogus numbers it says "Upon receipt of payoff funds, Ocwen will verify all amounts due and conract the issuer of the funds in the event of any discrepancies. In the event that the payoff funds received are less than the total amount necessary to satisfy the loan, Ocwen will return the funds and continue to accrue interest on the loan. Also it says, if payoff funds are received after the ecpiration of the grace period, if such a period is applicable to this loan, a late charge will be due. Payment of all late charges will be repuired to be paid prior to the application of any payoff funds and Satisfaction of the Mortgage/Deed of Trust.
The grace period expiration date is a week before I asked for the payoff quote.
I am scared to send them a large amount of money, I don't believe they will release the Deed of Trust. I have asked for a specific contact person to discuss the payoff deal and the discrepancies already, to no avail.
What do I do? I see they have already "set me up" with bogus collections notices, and intentions of not releasing the deed.
Acording to RESPA they are in violation for failing to notify me of loan servicing, and have only had my loan 45 days.
I'm glad I found all the complaints here because I really thought I was going insane..........What a mind f___.
