In 2007 I contacted Pacific Debt (after checking them out on the internet) to help settle my debts with credit card companies of $15,496.83.  I was told it would cost me $275 a month and it would take about 4 years to clear my indebtedness.  I was faxed a Power of Attorney and furnished letters for me to send cerified to all creditors.  All debts have been settled (I thought) except for one to Discovercard in amount of $1,810.03.
When I called Pacific Debt, they said I didn't have enough money in my escrow account to negotiate for a settlement (I had $497 in my account).  They said I would need to put about $500 in my account to begin negotiations.  They also advised that I still owed them $2,279.64 in back settlement fees.  They said that I was under a signed contract.  I did not have a copy of the signed contract and they emiled it to me. Upon reviewing what they sent to me, I found that I never received this contract.  The contract is not signed by me; it is a typed signature element.  I never received this contract (unsigned).  They said I agreed to pay 30% of the settled debts.  I kept every piece of paper they ever sent to me.  There is no contract among them.  They stated they telephoned me to get me to agree with the contract, but they could not produce the phone call or a copy of it.  I requested a copy of my account from NoteWorld Service Center and found they withdrew $479 from my escrow account for back settlement fees.  This withdrawal from my account left me a zero balance.  I called Pacific Debt requesting they not withdraw any funds from my checking account for June, July, August 2011 until this matter is straightened out.
I need the $275 they continually withdraw to pay for many health care needs regarding a recent hospitalization for a heart attack, pending back surgery, several strokes I have had in the past.  I feel I have been ripped off by this company and Noteworld Serving Center and I am trying hard to get my indebtediness settled, but I am owing more money than I can afford to pay them.  I think these companies are a scam to get money from those who live across the country because it is their word against mine.  I feel my unsigned contract is not a contract at all and is illegal.

Cancel My Rip Off Report on Pacific Debt

AUTHOR: Jeanne - (United States of America)

POSTED: Thursday, August 25, 2011

Last month I filed a report on Pacific Debt, a debt elimination firm in San Diego California.  Shortly after filing the report, Pacific Debt called me and followed up with an email request that I get in touch with them.

I called them and spoke about the report.  To make a long story short, we resolved my complaints and I assured them that my comments were not meant to demean them as they had always provided me with excellent customer service, but were slow in furnishing me the data I had requested.  All problems with this company were resolved to my complete satisfaction.
I assured them I would ask that you delete my Rip Off Complaint from your website and I sincerely hope this email will take care of that matter ASAP.

Thank you Rip Off Report for your assistance in helping me to resolve this situation.

Pacific Debt has been in business for close to 10 years and helped thousands of consumers. We pride ourselves on customer service and as result we have never previously had a complaint on the Rip Off Report. We are definitely not a scam and we conduct business in a legal and ethical manner.

All of our clients do complete an online agreement and consent to an electronic agreement prior to retaining our services. On the agreement the IP address of the user is listed to verify this agreement was not completed in our offices and was in fact completed by the consumer. In addition to the external IP address we record, our customer service department completes a recorded Quality Assurance call to ensure that you understand all program aspects, including the Savings Fee you describe.

Based on the information you have provided I believe I have identified your account and would be happy to email you a copy of this recording. More importantly we never want a client feeling "ripped off" and I would be more than happy to review your account with you and see if we can come up with an agreeable resolution.  I will have our customer service manager call you to discuss this further and see if we can resolve this to your satisfaction.
