I understand that something included in bankruptcy stays on your report for ten years. However the the debt that Palisade Collection says I still owe was included in bankruptcy and they still are reporting it to the three credit bureaus as an open collection. I have sent them the bankruptcy discharge with the creditors listed and they still refuse to do anything about it. At one point the actuall removed it ant then put it back on. I understand it is illegal to do this. I have written to the Federal Trade Commission about this. I am not going to let this drop. I had to file bankruptcy as a last resort and I have worked very hard for the past four years to make things better. I am making an appointment to see an attorney. Maybe they can help me.

Nancy, send a copy of your bankruptcy schedule showing this debt was part of your bankruptcy, a copy of the discharge paperwork, and a copy of all the letters you sent to the collection agency to each of the 3 credit reporting agencies, certified mail, return receipt requested. Unfortunately, this will cost you about $5 each, but it is proof of mailing and delivery.

Once Transunion, Equifax and Experian have proof that this debt was included in your bankruptcy, it is their responsibility in accordance with the Fair Credit Reporting Act to ensure that the entries on your credit bureau report are correct. Put the job on them, not the loser collection agencies. When they correct your credit bureau report, they will each send you a copy of your corrected report.

SAVE EVERYTHING!!! THEN, next year, if the loser collection agencies try to repost the information, you've already dealt with the credit reporting bureaus and can sue them AND the collection agencies for violating the FCRA. In addition, if you used an attorney with your BK, you may want to give them a call so they can write a letter on their letterhead on your behalf. For some reason, letters from lawyers tend to get action. Good luck!
