I started working at pizza hut on may 26 2009.On my application under languages you speak i checked only english i am not fluent in speaking spanish i can understand a little.   I am hispanic and being so i believe i am  subject to people assuming i speak spanish fluently. When hired i was asked by the manager gladys sosa if i spoke any spanish i answered a little because i thought i could learn how to take a phone order easily.   when i began i realized that gladys favored the bi-lingual employees so i tried my best to take a phone order in spanish.    I was receiving about 16-23 hrs a week at first,until gladys realized  that i was having trouble with the phone orders in spanish then my hrs dropped dramatically to 9-13 hrs a week just like the other employees who did not speak any spanish. when asked i told her you knew i was not a fluent spanish speaker.       I questioned my hours and was told if you work harder your hours will increase. so despite the fact that i felt discriminated against i gave 110% everyday but saw no increase in my hours.i noticed that she was not happy that i would speak up for myself.        Then i started getting accused of things like giving my employee discount to people other then myself by her most favored employee santos which my coworker anthony brown helped me prove by pulling up all the receipts from that night. when when i asked him why he would tell the manager that he got defensive and called her back.I dont know what was said but a week later i had only 9 hrs.     I was then accused the following week of taking pizza and chicken wings without paying for it. i insisted she review the cameras she said she would but that i would be suspended during the investigation and to come back the following wed for the results and i did but she was not there. so i went in again thurs and she told me to come at the end of the week because the investigation needed more time.   so once again i went back and was given the run around for the 3rd time to come in monday at 2:00pm.    When i went in on mon she handed me a check and said "your right you didnt take anything, but i need to terminate you for speaking to employees while under investigation". i calmly told her it was unfair and asked for her bosses number she said she didnt have it but i remembered writing it down a while back when the problems first began.      when i called him and told him the situation i was told that i would either get a call back that day or the following and still have heard nothing and have not been able to contact him myself.    I then called gladys for the corporate office i was informed that it was under new management and that she did not have the old number so i called the new office and was told it had nothing to do with them to contact the previous owner.    I did not know who to go to so i asked my sister for advise and that is why i am here asking for help i feel that this could jepradise other jobs for me in the future.  Please help me with this injustice.

I don't know the state laws in California, but I know in Missouri, employers can terminate employees for no reason. 

The only part they can get in trouble with is if they discriminate against you for age, race,disabilities, etc. The other way they can get in trouble is if they accuse you of wrongful theft or something, you get sue them.  However, your winnings would be fairly small, and you would probably make barely enough to pay your attorney.

I sympathize with you.  I am a victim of a similar situation, where someone's itouch was stolen and without any proof, I was fired. I was picked out of 10 employees it could have been because I "didn't have as many hours as most of the employees" (it was a 2nd job and I had just returned from a vacation) and I "mentioned having to make money for college" and that everybody thought I took it, so it would be awkward (according to him).  Sad part is she never got her itouch back and the person who stole it still works there. Hope they feel guilty!

However, if you know a lawyer, have them write a threatening letter to the place, telling them to compensate you (severance or something) and that you are prepared to take them to court if they don't. 

My suggestion is to call or go online to you state's labor department and find out what the state's laws are.
