POD under contractors name who abandoned job and pod on my property and PODS refuses to talk to us because not under my name but wants to hold us liable for pod and contents. Below is an email that was sent to them that explains it all: This is my last and final attempt to resolve this issue. I have made several attempts to resolve the problem unsuccessfully. A contractor by the name of ------- rented a pod to put some furniture in while he worked on my home. He ended up abandoning the job and left this pod on my property with debris that he was supposed to dump.

I have tried to get the pod out of my property several times but no one will talk to us because it's not under my name but the pod is on my property and I am being threatened by my homeowners association to have a lean put on my home if it is not removed by Saturday, August 25. Someone actually came today but did not take the pod because of the debris that was left inside by the contractor. This needs to be removed asap and you need to charge the contractor for the dumping of the debris. Like we are told everytime we called PODS, it is not under our name so you can't talk to us but want the debris to be resolved by us? Does not make sense!

I have called the Rancho Cucamonga police department and deputy C.Allen has submitted incident R982350302 which I plan to use if this becomes a legal matter. Get this pod out of my property or I will be proceeding with a law suit. You are quick to not talk to me and dismiss me even though your pod is in my driveway but want to hold me liable for it and it's content. Again this is my last attempt before proceeding legally as all of my other attempts have been immediately rejected because the pod is under the contractors name. Please advice as soon as possible on this matter. I only have 1 day before the association puts a lean on my home!

 You are correct in all that you say but the HOA has been patient because we have been communicating the situation with them and have not fined us yet. We don't have any fees accumulated with the company because the POD is not under our name. We can't even talk to PODS company. They refuse to talk to us. We didn't even know there was stuff in there until recently. We thought it was empty. Even if we dumped all the debris inside they still won't talk to us to even schedule a pick up because it's not under our name and we can't even pay them if we wanted to because it is not under my name. This is my issue. I can't even arrange anything with them to take care of any of thier demands because they won't talk to us. This is why I filed a report. The police was actually looking into how they might remove it and impound it but they said they couldn't. The officer was so bothered about my situation that she told me she would talk to company if I needed her to. She just couldn't understand how they wouldn't at least talk to me to arrange something but want to hold me accountable for it because it's on my property.

I do feel for your situation, but it seems while you are digging your heals in, you may have dug them into quicksand.

First of all you said you filed a police report if it becomes a legal matter, well if they are putting a lein on your property it has become a legal matter, there is no IF about it.  So if you haven't been talking to an attorney, you really need to do that ASAP.

HOA's have a legal process that must occur in order to do this, this is often defined by the HOA charter and local regulations. For the HOA to get to this point, it is likely you have had several months of fines that have possibly gone unpaid, which may be a bigger issue.

However, IMO if there was a choice between cleaning out a storage unit and having a lein put on my house, I probably would have chosen the former to get rid of the unit and figured out who owes who later.

As for the contractor, you may have a valid action against them for not only all of the charges they caused, but if you paid them any money for work that wasn't performed. If they were licensed you could also file a formal complaint with the State's licensning board.
