I signed up for the training program through Professional Fitness which is located inside of Work Out World. The twelve month program involved one 1/2 hour session per week for $25 per session.

I was cynical about the whole thing at first, especially when the big contract was pulled out. However, I had received one session and was impressed with the workout I had received in the 30 minutes I was there.

I specifically asked the general manager at this location if I could cancel at anytime without penalty, and was told yes. I signed the agreement.

My first visit went horribly. The trainer assigned to me was a no show, and I was put with another trainer who was already training two other people. The following appointments I was with the same trainer but scheduling was impossible and he also "forgot" about one of my appointments and another he was leaving the gym as I was walking in. NICE.

Ultimately due to personal reasons and a shoulder injury, I chose to cancel. After only 4 sessions. At sign up, they charged me my 1st and last, which was $200, and a $39 processing fee. Another $100 was debited out of my account during the first month.

Now that I am trying to cancel, they are telling me that there is a $225 fee to cancel (25% of the unused portion). This is on top of the $339 I have already paid!!!! For only 4 half hour sessions!!! What a ripoff. When I tried to be reasonable and ask if the money already paid could be applied to the fee, as I have not used the services, they tell me no. Even though in their own contract it states that they can only keep the money if I choose to consume the unused portion. DO NOT USE THIS SERVICE!!!!

I'm sorry to hear you're going through this. As stated in a previous rebuttal to a report I have family that works in the field and corporate office of the company. Here's my advice:

Contract:
Always read every line of the contract before signing it--front and back--because regardless of what the trainer/manager says to get you to sign it...the contract is legally binding. Anything said by the gym staff is repudiated by the contract that says "BF Central/BF West/BF Southeast/BF Florida/Atlantic Coast ABS makes no expressed or implied warranties other than those directly stated henceforth in this contractual agreement..." Verbal agreements are null and void when compared to a written agreement because you have no proof of what was verbally said.

Also, the gym guys can't help you because most of them don't have any information. Your contract isn't there, so you can't cancel there which is why the contract states "do not submit cancellation to health facility at which you executed this agreement."

The contract and sessions are for Professional Fitness only, so if your gym membership ends but you have unused personal training sessions, you're still responsible for paying for and/or canceling your Pro Fit membership.

Refund:
Also, the contract states in multiple places on the front and back that you only get a full refund if you cancel within 3 business days of signing the agreement. After that regardless of whether or not you used any sessions, you don't get a full refund and you do have to pay a cancellation fee (which varies on each contract).

Advice:
Complain to the managers and corporate office of Work Out World (or whichever gym you're in). Keep in mind they have their own business and reputation to maintain, and it's bad for business to have a client threatening to go to the press, Attorney General, and BBB to complain about the "scam artists" they're allowing to work out of their location. If you can locate other clients going through the same thing, then get together and submit letters repeatedly to the actual gym's corporation--not Professional Fitness--because they're not going to let their reputation go downhill. Take it a step further by stating you're going to tell friends, family, co-workers and others about the 'scam artists' they're allowing to work out of their location. Most businesses get additional business through word of mouth, and this is the age of technology. There's blogs and sites like this one that take word of mouth even further. I have heard of a lot of people getting quick results when they complain directly to the gym's corporation because the owners of the gym go directly to the top bosses of Pro Fit telling them to completely refund the client or they'll be kicked out. In some instances, Pro Fit has been kicked out a few locations in Fayetteville, North Carolina such as Eutaw and Bordeaux. IF you feel a lawyer will further help emphasize your disappointment in the services rendered, then go for it.
