Like many Mexican timeshare scams, Puerto Bahia Villas and Spa salespeople and their backups will sell you timeshare and promise you guaranteed rental income under the name of "real estate fractional ownership". They use this to tell you that you waive your right to cancel the transaction. This is not true: Article 56 of Mexican Federal Consumer Protection Law says you can cancel in writing (email is fine) within 5 business days: http://embamex.sre.gob.mx/canada_eng/images/consumer.pdf (You cannot waive this right). Puerto Bahia salespeople will then throw alcohol and outings at you to distract you from acting to cancel within 5 days.

Make sure you send email/letter of cancellation within 5 business days! If Puerto
Bahia argues with you, contact PROFECO (Mexican Federal Consumer Protection) or hire a Mexican timeshare lawyer (the guy we contacted quoted U.S.$2000 flat fee on delivery of a cancelled contract but could not guarantee money back).

Timeshare Scam

This company is one of the most fraudulent developers ins the timeshare industry. The only thing you can do is cancel your timeshare contract. I "bought" into this company two years ago, and did cancel within 5 days. No money back, as previously said. But I sent all the documentation to the Consumer Protection Agency, went to see 2 lawyers, went back to the site,on and on.. Profeco- the consumer protection agency fined the company but has NO LEGAL Ability to enforce the fine. So it is ignored. For 1 1/2 years, Puerto Bahia IGNORED the requests to meet Profeco. And then they told my lawyer that they could not issue a refund.
The lawyer said I could go to court, but it would cost me the same amount that I lost.
I am curious if anyone has actually enjoyed this place.
It is now registered in the RCI tour book!
I will never buy a timeshare in Mexico.
I do own in Florida, with Wyndham, which I usually exchange on the RCI network, and pay the additional fees. But I have title to the land, and know what I have purchased. The only complaint I have with this is I have yet to exchange for Maui, but I have gone to Vegas, Hawaii, and Mexico with it.

Puerto Bahia Villas and Spa is one on the most fraudulent timeshare companies in Mexico, i'd rather stay away from them after all the complaints i've read about this company. I know a legal company that can give you a totally free consultation on your matter, this is their website:
