There are multiple issues with this internet based rock merchandise company, Rockabilia, so I will make a list:
1) This company charges your credit card prior to shipping any items, even if your items will not ship for months.
2) Most of their items are not in stock which they do not tell you until after the order is placed and your credit card is charged. Items that are not in stock can take 8 weeks or more to ship.
3) If an item is lost in transit, they do not refund or reship your order. You are screwed......you don't get your order and you get charged in full.
All of the above happened to me in one order, the last order I will ever place with Rockabilia. I ordered 2 rock band tank tops for my son for Christmas. I placed the order on Black Friday. The one tank was 'in stock' but took 10 days to ship and I never received it. When I contacted their customer service department, I was told to call the post office to see if they could find it!! I was told they do not refund for lost shipments. The other tank was not in stock and 'may' ship in 8 weeks.....certainly not in time for Christmas.
If you are looking for music merchandise (band t-shirts, sweatshirts, accessories, etc...), do NOT shop with this company. They make it look like they've got the largest selection around and that they have it all in stock but they do not. Use a different on-line vendor, go to Hot Topic in the mall or go right to the bands website to look for merch.

Under the Uniform Commercial Code, the seller is responsible for delivering the goods to the buyer. The seller in this case failed to perform his part of the deal. The seller needs to either replace the lost goods or refund the money.
I ship from time to time using the postal service. Priority Mail starts at about $5.00 if you open an online account and includes a tracking number at no charge. Hard to believe that a mail-order company would ship without some sort of tracking numbers. BTW, insurance always protects the shipper and the shipper is always responsible for initiating a claim for a lost shipment.
Lisa, you should file a dispute with your credit card company. You can find the instructions for doing that on the back of your monthly billing statements. Generally, phone calls or emails are not accepted for disputes.
I do not normally deal with small-time mail order companies, but I thought there was a federal requirement that if they cannot ship within 30 days they must inform you and give you the option of waiting or terminating the order. Look into that.

I did NOT choose the shipping company, Rockabilia did. I did not enter into a contract with the third party shipper nor did I pay them; Rockabilia did. Therefore, it is their responsbility to follow up with them and make sure the material I paid for is delivered.
If a company bases their entire business around 3rd party shipping companies, than they must take responsibility for those shippers. On-line companies can not exist without these third party companies so it's the cost of doing business on-line. I know this first hand because I work in customer service for a highly sucessful on-line company. Our shippers are an extension of OUR business.....if they fail, WE fail. That is how we run our business and it is why we are successful. Yes, we lose a few bucks here and there but what we gain is a loyal customer base who knows that we honor our word, our commitment and our products.

Its unfortunate but why would you think the sending company should refund your money? Its the shipping company you must take your issue up with. This is the problem of ordering something online, sight unseen. Atleast in a brick and mortar store the item is RIGHT THERE!!!
During this time of year the shipping companies are overloaded. There is a good chance your package is just fine, its probably sitting in a pile of boxes that they are working on. You need to file a claim with the shipping company. This is the ONLY way to get ANYTHING back. Because the company that you ordered it from has NO RESPONSABILITY once it leaves their facility. Why is it that with these online ordering complaints, you consumers ALWAYS blame the sending company? Do you not realize that there is a third party in all of this?
Im not defending their shipping practices, but its really unfair of you to blast them when they had ZERO responsability in getting the package to your residence. Thats all on the shipping method YOU chose. I feel you are blasting them because you do not or did not know better. Well now you DO know better and you know where to point your verbal guns.
And no they WILL NOT just reship your order, they have no proof that you DID NOT recieve it. So they will not reship it due to that fact. THEY do not know if your yet another scammer and they must protect themselves and the business. No they will not give you a refund either. Once again, as they are not responsable for the shipping, it falls on the shipping company to process ANY missing packages.
