Rocky Mountain Biewer Terriers Karen and Jared Hansen BiewerWorld.com , facebook.com/groups/rockymountainbiewerfriends/ They offered us a pup, made sure we typed "we are willing to wait" with deposit as the dog was tiny, and then sold to another person if she ever existed at all. Then kept our 500.00 deposit saying it was for a "future pup". Delores Colorado

To whom it may concern:

  Back in May 2018 a while after we lost our dear pet Sophie to cancer at 71/2, we started to look for another puppy.  We decided on a Biewer Yorkie, as we have always owned Yorkies and we love them, and know how to care for them.  In our efforts to look for a healthy pup, we came across Rocky Mountain Biewer Terriers.  We looked at the website.  It looked good.  I checked the BBB.  5 complaints in 2 years, all supposedly closed satisfactorily.  35 reviews that were positive, and about 4 that weren't.  they had an A- rating.  I didn't read the reviews, but wish I had.  I also checked that they were listed on the AKC website.  They are.  

Thinking I had done my due-diligence on them, I contacted them regarding looking for a puppy.  They did not answer their phones but they did message, mostly through their FB site.  We discussed that they wanted a 500.00 deposit, but I told them I was reluctant, because we wanted a small girl, which are hard to come by.  Karen said she "would talk to her husband " about giving us a refund if we sent one, if we found another pup before they had one.  I didn't send the deposit and decided to wait.   One weekend, they posted a mini girl.  I contacted them about that puppy and also inquired about another one.  We messaged at length, and then we finally decided to place a deposit for the mini.  Because she was not listed on their website, we HAD to choose the "deposit" option, with no particular puppy listed.  We were also instructed to write that we were willing to "wait" for the pup, because she was small, and sometimes they can not travel as soon as other pups.  We did as asked.  

About 2 hours later, we received a message that our pup "was sold".  Not to us.  I immediately tried to call, but they would not pick up.  So I called my credit card and opened a dispute.  This made Karen very ANGRY.  After messages blasting us for doing this "so quickly", and us messaging that we did so immediately because we realized we were being scammed, she finally agreed to refund our money, and proceeded to block us from being able to contact them in any way.  This meant that we could not have bought a puppy from them to this day if we wanted to.   When our CC company contacted Karen and Jared, They LIED and said that "we had put a deposit on a future puppy" and sent a screenshot of our comments that "we would wait for our perfect puppy for as long as it takes".  Capital One, sent a non-certified letter asking for more information from us.  WE DID NOT RECEIVE THIS.  We are not sure why.  So we believed until last week, that we had been given a refund.  Until we got a statement showing a Re-bill for the 500.00  

As we began the process with our CC company, a number of emails were being sent back and forth with Jared and Karen while our CC company was trying to see if they could help us at all.  When our bank called them (even when it was scheduled) they would not pick up.  Two times Karen did happen to pick up, and then just yelled at the rep calling and hung up, so they couldn't resolve things.  Finally after a complaint to the BBB as well, Jared called me.    In extortion fashion, he stated that he would paypal me money as I fulfilled "demands" of 1:  Closing my dispute with the bank, and 2:  Closing my complaint with the BBB.  Then he added taking their name off of social media where I warned others what happened to us.  I asked how I knew he would pay me.  He actually sent an email listing his extortion demands.  He left out the part about that he would send money via paypal to me.     As I did as he asked, and provided proof I did this.  All of a sudden, the story became that "they couldn't refund the money at their bank end due to some problem being able to refund".  I told him that he agreed to paypal.  He refused.    

So, in summary, we gave Jared and Karen of Rocky Mountain Biewer Terriers 500.00 for a puppy that may or may not have existed.  They "sold her" and didn't give us our money back, yet they also blocked us from being able to buy another puppy.  We want to be clear that WE DO NOT WANT A PUPPY AS A RESOLUTION AT THIS POINT.  We were extorted into closing our complaints and still no money.  I have over 20 documents proving everything I have stated.  Here is the extortion letter:     Hi Linda,   As per our conversation, we will refund your deposit of $500 based on the conditions we agreed to.    Conditions: 1. Cancel the chargeback initiated with your bank.  2. Withdrawal your complaint with BBB.org   If you complete both of them right away, we can send the full amount. If you want to take steps to insure we commit ourselves to the refund through your actions, you can satisfy condition 1 and we will send a refund for the $300 portion of your deposit. After that you will need to satisfy condition 2, and we will refund the $200 portion of your deposit.    I know things didn’t work out initially, but I hope we can resolve this matter favorably for both of us and that perhaps one day in the future we might have an opportunity to work together.    Sincerely,   Jared Hansen Rocky Mountain Biewer Terriers & Poms  info@biewerworld.com

Since this has occurred, I have learned there is an ENTIRE site on FB devoted to people who have been scammed out of money, sold sick puppies, or didn't get the "puppy in the photo".  These dogs were sold for between 3000 and over 6,000.  One woman contacted me who paid 6,000 for a show dog, and received a sick dog that needed 2500 of dental work to save his life, and he was unable to be shown because he lost all of this teeth.     My story is one of currently 23 people to date.  The website is facebook.com/Biewer-world-truth-about-puppy-mills-1399105870180515/?fref=nf (since I have written this, the scam artists had the site taken down by FB).   Most people remove posts because these people threaten or extort them as they did me.  They have already called their Colorado police department, and I got a call from them a couple of days ago asking if I was harassing THEM.  Fortunately, the officer took the time to listen to my story, and look up the site, and said to just not contact them, but to keep going through the proper channels.  This letter is one of my many attempts to "go through the proper channels".   I can't believe that in this day and age that they can continue and nothing is done about it!  PLEASE shut this scam/puppy mill down!     Sincerely,   Linda T

Of course these people have proof that we asked for the puppy with certain colors and said we would wait! They told us to write that because the puppy we were supposedly buying wasn't pictured on their website for us to place a deposit on the pup. Why? We were told that because this pup was small, we would have to wait longer (to be determined by them) for the puppy to be big enough to travel. We simply wrote what they said we had to! The reason for two payments, is that when we made the first deposit, we recieved a message that stated we had not paid "enough" to hold the puppy. Of course, we were the only ones to see photos of the puppy. I did do a chargeback as soon as we realized we were scammed. The puppy mill lied and said that we put a deposit on a "future puppy" and that they had a NO REFUND policy regarding deposits for future pups. They knew exactly what they were doing. Below is the extortion letter we were sent after filing with the BBB . Although we did as asked, we were blocked from all sites, never recieved a puppy, and never got our money back. The proof of the scam is in the outcome. I ask these puppy mill owners who take the time to file this fake rebuttal one question: WHERE IS OUR 500.00?! IF YOU BUY FROM THIS MILL, YOU WILL LIKELY EITHER RECIEVE A SICK PUPPY, NOT THE PUPPY PICTURED, OR NO PUPPY AT ALL.  For what it's worth in terms of character, please read below the pending FELONY charges that are public.

The buyer sent $500 deposit in 2 payments on 5/19/2018 and on 5/23/2019. She also wrote a message with each payment, describing the size and color of her future puppy. She also wrote that she would wait as long as it takes for the right puppy to be born. She did not reserve any specific puppy. In her ripoff report, she wrote: "we finally decided to place a deposit for the mini". This is absolutely untrue! 

  • I am attaching the order confirmation including the message to us. 

On 5/26/2018 the buyer asked some questions about puppies she saw on our website. She requested additional pictures for one of them. The conversation ended with her statement: "I will just wait, let me know when she appears"

  • I am attaching the messages from the buyer stating that she would like t wait for the right puppy

3 days later the buyer sent us a Facebook message, stating that she wants a refund for her deposit and that she would send a new deposit once she sees a puppy on our website that she likes. 

Just 6 minutes later, before we got t actually read her message, she sent another message, stating that she had filed a chargeback with her credit card company.

Once a chargeback is filed, the money is withdrawn from our account and we have no access to it. It is impossible to issue a refund when a chargeback is filed because the funds have already been withdrawn by the cardholder's bank. 

We explained to her that we can only issue a refund if she would cancel the chargeback with her bank. She then claimed we have been extorting her.
We did contact our credit card processing company to see if there is anything we can do from our end but were informed that the funds have already been taken from our account and nothing can be done.

I am attaching several other documents to show proof that this ripoff report against us is fake.
