To Whom It May Concern:

I bought a mattress (which cost me $1,500) from Levitz in September of 2007 (a mere 8 months ago). I also purchased the head board, foot board and adjustable frame from Sam Levitz some time ago. The purpose of purchasing this mattress was because my old one was sagging in the middle. Unknown to me, the frame (that came from Sam Levitz) my old mattress was on was broken. Sam Levitz told me the welds broke which made the bed sag. The reason the welds broke, I was told, was because the frames feet were not adjusted correctly. This was not determined until 4 months after I got a SECOND bed from Sam Levitz.

I called Sam Levitz in December of 2007 because my brand new bed (that I purchased in September, 2007) was sagging in the middle. They came out to look at it. It took them more than a week to do that. About a week and a half after that, I received a new mattress and box spring.

I had to call them again in early April of 2008 because, yes you guess it, and once again the mattress was sagging in the middle. This time it was determined that the frame the mattress and box spring were setting on was broke, because the frame was probably set up incorrectly. I received a new frame, which was delivered on a Saturday (May 3).

When the mattress and box spring were placed on this new frame, it still sagged in the middle and it felt like it was angled down, so it felt like my head was higher than my feet. I tried sleeping like this for two nights and couldn't do it. I woke up in the morning with a back ache and a head ache. I called Sam Levitz on Monday morning (May 5, 2008); they said they needed to send out a technician once again, but he couldn't be there for almost a week and a half. I told them that I could not sleep in my $1,500 bed in the condition it was in, that I was taking the bed off the frame. It felt the same way when I had the box spring and the mattress on the floor. What I finally had to do was put just the mattress on the floor, so I could sleep on it with some comfort. BUT it still feels like it is sagging in the middle.

The technician showed up on Tuesday May 13. I did not hear from Sam Levitz until I finally called on Friday May 15. I was told the manufacturer would not return the bed because the mattress was on the floor (YOU MUST BE KIDDING ME). If I didn't finally call, would I have ever received a phone call from them? Needless to say, I am furious!!! I called the store on Orange Grove on Friday afternoon and asked to speak to a manager. I spoke to Connie who told me she would look into this and call me back.

Well guess what, I haven't heard back from her either. No surprise there!!!

All I am asking for is for my bed (with a 10 year warranty) to last for 10 years, NOT THREE MONTHS.

Please see the enclosed photos, they show the condition my bed has been in for almost two weeks. I have been waiting for over one month to get this resolved with no prospect of that happening in the near future. I should be able to sleep in my bed with the frame, head board and foot board setup, not sitting against my wall.

So far I've taken 5 days off of work to wait for the delivery of two mattresses, the technician to come out twice and the delivery of a new frame. How much more time must I loose to resolve this issue?
