A year ago I was behind on my mortgage, I went through their forbearance plan. I made each payment monthly. I completed the work out program, now I am being assessed fees and charges due to a clerical error on their behalf.

Apparently under their work out program they failed to set up escrow payments, they paid the taxes, I recieved a notice that the escrow account was in a negative balance, but nothing further, no demand for payment over it. I assumed they would eventually send me a notice or contact me to add that into my work out plan.

They never did, they simply took more than double my normal escrow amounts out of each payment, causing more fees that they eventually used to claim I had not paid two months worth of payments.

I can never reach the same person twice within that company, I get a run around, told to call back on certain days. Every person I have talked to looks at my payment history and concludes I have made all my payments. No one can figure out why they placed my loan in default over their mistake and indeed even though I have received notices from them and the NCOCB regarding my loan status as being in default this company continues to tell me it has not been.

They mailed me a loan modification application then.. but told me to wait for the new government programs to roll out in April. They promised a copy of my payment history, my only defense... I have yet to receive it. I do have assurances it is in the mail, much like the assurances my loan is not in default due to this problem being of their creation.

I am frustrated by their total lack of cooperation, and the disingenuous way I am being treated by this company. They (according to letters not conversations) plan to accelerate the not and foreclose on my home due to their clerical error. I have managed to get them to move some of the fees to the end of the loan, however I do not feel even that is fair, although it lessons the amount they wish me to repay.

I make too much money to qualify for legal aid, but my mortgage is to high to hire a private attorney, a situation many of people dealing with this type of problem are incurring. I was hopeful the company would help me, help them resolve this situation until I began to learn of the sheer volume of similar problems others are having with this "loan service provider".

If I get poor service at a store, I can take my business elsewhere... I do not have that luxury as they purchased my loan without my having any voice in the matter. Part of me wants to attempt to raise the funds to simply pay them, however scared I am of losing my home, I'm more fearful that more clerical error on their part will continue to place me at square one, and that without some advice, or help they will eventually force me from my home from no fault of my own.
