My husband and I were approved for a loan mod in Jan 09. We completed all the correct paperwork, had it reviewed by our attorney and sent them a cashier's check for 3k. We had to send it in by Feb 1. It was received and signed in their office on Jan 30th. Since then we have all ready made 2 mortgage payments-at the new loan mod amount and are getting ready to make our third. Since Saxon online is not current-shocker!!-we have been making those payments via telephone. Everytime I call to make the payment I always ask if everything is still ok and the loan mod is still current. I always get " Yes! Everything is perfect with your account.".

We received a letter in the mail just this past weekend stating that our loan mod has been denied due to the office not receiving our paperwork and or funds on time, and our house will go back in foreclosure. So we call on Monday. Not only were we on hold for 2 HOURS, when we finally got someone and started to explain our problem the computer "crashes" and we are asked to call back. So of course we do and sit on hold for 1 1/2 HOURS for someone to pick up and say "Sorry, nothing we can do".

So I call back and speak to a supervisor in the home preservation dept. He tells me that "there was a mistake on Saxon's behalf and we will have an open ticket on our account so they can reinstate our loan mod. Everything is ok and to continue making payments as usual. Also to disregard any notices we get in the mail pertaining to foreclosure". So i'm thinking its done there. My husband got a phone call on Tuesday from Saxon telling him they have to re-do our loan mod because THEY lost the paperwork. They are going to give us a higher interest rate, make us put 3k MORE down and agree to have our monthly payments higher. My husband politely explained to the gentleman that was not going to happen.

We have copies of all the original loan mod paperwork-All 4 copies because they could'nt get the numbers right the first three times- Proof that the cashiers checks have been cashed and the delivery receipt from FedEx that their employee signed for. We would be more than happy to fax it over to them. The gentleman said he wasn't aware of all this and he would have to check with his supervisor and call us back.

We have been dealing with this dumba** company since June 08 in regards to the loan mod and foreclosure. This whole thing has me so confused and beyond aggravated. I wish I could change my mortgage company like I can with my cell phone. All they want is money and your home. they could care less about you and your family. It's beyond me how we did everything they asked us to do and then some and we are still going through the circus. There has to be some legal rights that people have in this situation against Saxon Mortgage. They cannot keep doing this to people!!!

Addtional Saxton Issues

I am also dealing with the same issue. My documents were due with cashier's check by March 2nd and they were received an signed for on March 1st (I have the Fed-Ex tracking as proof), cashier's check has been cashed. I have made the payment which was due on April 1st 2009 and the check is being held and has not been cashed. Saxton sent me a letter stating that they can no longer help me due to the fact that the documents were not received in time.

I have spent so much time and over 20 + calls trying to get this sorted out with no resolution. I have asked for a call back at least 6 times and no one calls me to give me a status update. I finally received a call from an outside agency that was requesting financial worksheet in order to look at a loan modification. I submitted them because I didn't know what else to do. I am so stressed out there has to be some way that this can be reported to Home Owners Preservation since they are receiving government funds to help out distressed homeowner and instead are causing them undue stress and wasting their time.
