 I purchased a phone for my mom who is hearing impaired at a cost of $149.95. Upon receipt, my mom still could not hear after three initial attempts using the phone in less than 5 minutes of usage.  The phone was immediately repackaged for return to Smithgear. I paid $18.45 in postage and insurance to return the item. In return, I received a return credit on my credit card for only $117.45. 

The policy of the company online indicates there is a restocking fee of 15%, which in this case should only be $22.49, from $149.95, and NOT the difference of $32.50 which was actually taken by Andrew Smith.

What happened to the additional amount of $10.01 due to me?  Did Andrew Smith pocket this money?

Is he doing this to other customers too?  If so, he is making money from honest people!

To me, this is a RIP OFF and I will NEVER deal with this company again!  Buyer Beware if dealing with this company!!!

Please let me make this right. This is a small company and as the owner I will step up and take responsibility when a mistake was made. Yes, I made a mistake that I did not contact you sooner. Please let me know what your order # is so I can correct this wrong. I am a human and I process a lot of orders and refunds and sometimes, I make mistakes. BUT I OWN UP to THEM when I DO. Please let me know your order # and I will refund your account.

You Never Responded To My Emails Or Phone Messages Before...Why Now?!

I left Owner Andrew Smith phone messages and emails before trying to resolve this issue, but NEVER received any return phone calls or emails from him.  I find it unfortunate and unprofessional that he is only responding now since this matter is made public.

I purchased this item in good faith and paid the bill in full upfront on my credit card, despite the fact that this item was returned to Smithgear whereby I paid an additional $18.45 for the return postage and insurance on this item out of pocket.  This item was not damaged in any way and was re-shipped in the same box it arrived in.

Andrew Smith took more than the 15% restocking fee in this case, with regard to the credit amount returned to me.  Why would any consumer want to pay $149.95 for merchandise, add another $18.45 for shipping and insurance since the merchandise was unsatisfactory and had to be returned, to receive only $117.45 back?

What happened to satisfaction guaranteed?  I question your advertising of FREE shipping and handling for merchandise over a certain amount...am I being charged NOW for the initial "FREE" shipping that was advertised when he initially shipped the item out to me since he has taken $10.01 MORE than just the 15% restocking fee?

I am disappointed and have lost respect for the poor manner in which Owner Andrew Smith and Smithgear have handled this transaction, especially since this is the first transaction I have had with this company.  Your failure to respond to my prior phone messages and emails trying to resolve this matter (prior to this RIPOFF resport) does not leave me with a good impression.  This will certainly be my LAST transaction with your company.

Hello, 

I'm very sorry to hear that the "hearing impaired" phone you ordered and we shipped to your Mom did not work out for her. Unfortunately, since everybody's hearing is different, most times we don't know how well the phone will help until a person actually gets one and tries it out. 

In instances like these, we do ask that the customer pay for shipping to to return the phone to us. 

I would like to straigten this out with you -- but you did not identify yourself in your complaint.
