Sofa Mart, Furniture Row, Laura, Lazy-Boy Deceptive Trade Practice, Failure to Disclose, Warning Waco Texas

On 12/15/2007 I bought a Lazy-Boy Recliner that was on clearance. Ms. Laura was my sell cleark, she told me that the recliner was returned because the customer that had originally purchased the recliner did not like the color and there was nothing wrong with it. So I bought this chair as a scratch and dent. I question Ms. Laura about the warrenty on the chair since this was a Lazy-Boy Recliner and she stated that since there was nothing wrong with the chair it is still under the warrenty.

Well I was moving the chair out of one room into another and notice that the arm frame on the base was falling apart. On 1/21/09 my wife called sofa mart and talked with Laura about the problem. She stated that it was bought as a scratch and Dent item and all Warrentys are Void. Then Laura and my Wife went rounds on the phone, and when she asked for a manager she told her that he would not be in till 1:00 pm. Well my wife and me live alittle ways out of Waco so we drove to Waco to speak with the Manager.

When I entered the store and attempted to speak with the Manager (I believe his name is) Cody, Laura kept interrupting me while I was talking to him. She kept saying when you buy something that is scratch and dent all warrentys are voided. I told her what she said and she stated that she did not remember what she told me. I asked Cody were is it written that if is scratch and dent that the Warrenty are Voided and he stated that it is not posted or Written any were.

So they are sending a Tech out today and he stated that if it can not be fixed I will have to pay the difference for a new one but it should still be under the Lazy Boy Warrenty and the Store Warrenty. Because were it is Broken somebody could get hurt if they sat in it.
