In my March phone bill SBC included an ad for a model SBC271 phone with one button voice mail access (my wife liked the one button deal). I logged on to the web site and there it said that all sales were final. I ordered the phone.

When I opened the package there was a large pink sheet that stated "Exclusion of warranties. This telephone is clearance equipment and is provided "as is" without warranty". None of this info was available on the web page where you order the phone. I set up the phone and programmed the voice mail button but it didn't work (instead of giving me my voice mail it recorded whatever background noise there was in my home and added 1 to the number of voice mail messages).

I phoned SBC and they finally agreed to send me a replacement phone (I'm supposed to pay for shipping their defective equipment back to them). The replacement arrived, I set it up and programmed it and it does the same thing as the original phone - strictly defective. Another call to SBC on 4/5/2004 and a supervisor agreed that they would have UPS pick up the equipment, at SBC expense, and issue a credit to my credit card.

As of today, 4/19/2004 nothing has happened. Called them again and was told that a higher authority has said there would be no pickup or refund.

SBC is guilty of false advetising by not stating that they are selling "as is, no warranty" on their web site or on the advertisiement included with my phone bill. I'm stuck with 2 phones that don't perform as advertised and I am sure that SBC knew they wouldn't becaus they put that "as is" pink slip in the box.

I also have the 271 model phone. I understand your frustration, but have to say that the 271 can be tricky to set up, but once completed, is Super easy! If you still have the phone and want to get the most from the features call SBC 800-585-7928, even though the phone is a close out model, it still a 1 year manufaturer warranty. Sounds like you need to talk to equip support for help setting it. They will walk you through from start to finish with the phone. Hope this helps. I couldn't be more pleased with the performance of mine.
