You got rear ended, you obviously were neither at fault nor contributory to fault. The other driver is the one that hit you - file suit and see how fast the  insurance company decides to settle. Just make the suit for a LOT of money, claiming pain and suffering, lost wages, loss of consortium if you are married - get creative with the damages.
