I made a cash deposit in the bank and then went to do my shopping. I used my atm card, which will not be approved unless there is money in my account. I have no overdraft protection on this account.
A few days later when I checked my balance it was in the negative 35.00. Because I was 1.00 short on a check I had written out. No problem.
The next day my account was about 150 dollars in the negative. Transactions that I had made and had posted to my account five days previously were now saying that they had posted that day. I had returned a rental car on a friday. Used my atm card to pay for it, the money was instantly taken out of my available balance on friday. Now five days later the computer was saying that that transaction was made on a Wednesday.
Currently, my account is about 500 dollars in the negative and it keeps going up. As soon as I found out about this un lawfull act, I called my lawyer. We decided that we needed more individuals that have experienced a similar situation. If you believe you have been charged un lawfull overdraft fees please email coreeng47@yahoo.com. My first step was to file a motion in small claims court. Now I am going to try to collect a group to boycott in front of some of the local td banknorth. And if I get enough we could file a class action suit. I believe that this practice is un ethical of the banks. In an ever so unstable economy I can not afford to give a bank 500 dollars just because I was 1.00 short and they wanted to take extreme advantage of this. So lets stop this NOW

heard this before from other people, i also know of one i just sent a copy of your letter to as i think they will be interested in this matter... PERSONALLY I WOULD NOT TO BUSINESS WITH BANKNORTH NOR HAVE I OR WILL I !!! HOWEVER I SUGGEST DOWNEAST FEDERAL CREDIT UNION THEY ARE A GREAT BANK AND I BEEN WITH THEM FOR YEARS. THE LADYS COMMENT FROM THE BANK, YOU ARE RUDE SOUNDING! SO ARE SOME OF THE OTHER COMMENTS AS WELL,, LIKE YOU"VE DONE NO WRONG YOURSELF IN LIFE!!! PLEASEEE GIVE THE LADY A BREAK WRITING WHEN ANGERY CAN MEAN YOU JUST DIDN"T WORD IT RIGHT.. YA"LL HAVE A GREAT DAY! .....the lawyer that wants to take a case such as this for anything other than laughable purposes. Unethical doesnt mean illegal.
I detest the fees these banks charge for over drafting and such.....so I dont allow it. I dont run my account low enough to risk causing them to assign such fees. NO I dont carry a BIG cushion or balance...but I do keep enough to pay my bills on time and dont spend more than I have.
YOU stated,

So you admit to overdrawing the account. HOW can you hold the bank responsible for the fees that YOU ALSO AGREED to when you opened the account .....by signing the paperwork AGREEING to the conditions the bank offered.
NO rip off here..other than you spending the banks money that is.

Charging your account every five days isn't unlawful...especially since when you signed up for the account, and signed a contract, you were given a personal deposit agreement, which clearly states the 35.00 dollar fee will be assessed
Nothing posts to your account "automatically" like you stated. It is the merchant's responsibility to initiate the transaction, not the banks. You obviously don't keep a check register, and spent money you thought you had in the account that wasn't there. Did you think the money fairy came and made a deposit into your account? My sister overdraws her account all the time because of the same reason. She'll have ten dollars in her account, spend eight of, and check and ATM. When the ATM tells her she has ten dollars because the purchases haven't cleared, she'll go out and spend more money...
you're ridiculous
