TITLE MAX I am paying a loan wiht a 140% and now I just had an accident and total my car. Now I am paying for a new car and for Title Max, which is a reapoff. Wha can I do. Anyone can telll me what happens if I stop payment. Roswell Georgia

I have a loan with TITLE Max for $3,000.00 since February 2013. I had just have an accident and I had to buy another car because the one pawned was total. I cannot afford paymen two car loans. What happens if I defaul on Title Max.?

dont pay them nothing they rip off people left and right. all they can do is repo the car since it a title loan.

 Titlemax is a Sub-Prime lender that is very agressive in making sure they get paid.  Having a car totalled doesn't just make the loan go away. So if you fail to pay them, since they can no longer reposess the car it is very likely that they will start with collection efforts.  This could eventually end up with them suing you in Civil Court.

If it ends up in court you will (with almost 100% certainty) loose and be required to pay not only the amount due but additional interest and court costs.  Depending on your state they may be able to attach(garnish) your wages and/or your bank accounts.  So it would be to your advantage to try and work something out with them.  But what ever you work out be sure that they put it in writing so you have proof of the agreement.

The real question is what about this accident.  If the accident was not your fault YOU should be going after the other party.  They should be the ones responsible for your car and any other damages you may have.  You need to push them to give them the amount you need to pay off this loan, if there is trouble with that a good lawyer may be in order for you.

Now, if you were at fault and had insurance, your insurance company should be paying off that car if you had the correct coverage.  Now, they may only pay off "blue book" value which may or may not be what you owe, but anything any insurance  pays you toward the totaled car needs to be paid to Titlemax..or you could have other legal issues.

If you have no insurance that covers you in this situation then unfortunatly you will need to figure a way to pay them off.

They will come after you of course.  You owe them money and the fact that you got in an accident does not change that.  Didn't you get something from your insurance? If you did you are expected to use that for the loan or to fix the car.

If you don't have insurance you are just out of luck but have to pay the loan off anyway.
