I was directed to this company via a broker called Warranties 4 Wheels ( totally useless in defending their customers saying it is not their fault). Ultimate on the past two claims was great paying the car dealer without delay. Now it appears they are out of money and being run by their parent company Capital Assurance. They are under control or monitoring of the South Carolina Department of Insurance.

I notified Ultimate or Capital that I was having problems with my rear differential and was going to take it to a licensed facility that employs ASE mechanics. They told me on 02/01/08 no problem, have the mechanic disassemble the differential and they have an inspector look at it on 02/04/08. This to me was a bad sign from the get go as they had never sent an inspector on any of my previous claims.

The inspector showed as promised, reviewed the parts in need of repair and said it did not look like a problem. Fast forward to 02/07/08, and my mechanic was notified the claim was rejected.

First they said it was because he started the work without authorization and disassembled the differential. He said both him and the customer were told to go ahead and do this so the inspector could look at it. The rep backed off and then said it did not matter because the inspector said the claim should be rejected.

The inspector said a vent tube was missing but did not make an issue of it during the inspection. My mechanic said the inspector should have noticed it sitting next to the parts to be repaired. He explained it had to be removed in order to take the differential out. The rep. did not care. The mechanic further explained the symptoms were not present in the differential had the vent tube been missing. The rep still did not care.

The rep said the inspector found water in the differential oil. My mechanic said there was no water in the oil. He further said he had it drained in to a collection pail. The inspector never looked at the oil in detail and never took a sample. My mechanic explained the oil was black, not milky brown which occurrs when it is contaminated by water. The rep did not care.

My mechanic explained the condition of the differential and how one set of bearings failed and caused damaged to the others. The rep. did not care. The inspector's report surprised my mechanic as he made no indications during the inspection that he was going to deny the claim.

So I am stuck with a car that needs repair. A company that will not honor it's contract with me. Should I repair it and if they change their minds, will they then reject my claim again because it has been repaired ?

It seems from the numerous complaints on this site and around the web, the company is attempting to get back on it's feet by rejecting claim after claim. This and getting people to make repairs first and then declining to pay because the repair was made without authorization.

I am stuck with a warranty that has four more years and over forty thousand miles of coverage on it. What government agency is going to step up for the consumer and protect us.

I am interested in a class action suit should one arise.

You misread what she said. We will get coverage for someone at OUR cost, not making a dime of profit to make sure people can get back on track and properly covered. We are only an agent we are not the administrator or obligor I personally am out almost 6000.00 dollars and are praying the rehabilitation goes through smoothly and soon! We have done all in our power as an agent to make sure that the Ohio AG's office, SC DOI, Assurant, CARG, and ARIC are on Notice to find the crooks who ran Ultimate and stole the money!

I wish somebody from your company had told me I had the option to be switched to another warranty company at no expense to me. This option was " never " stated to me. The only story I got from Wayne was that he and some of his employees were in the same boat as me. While I can relate to that, what does that have to do with me ? Your company brokered this plan to me and as far as I am concerned never made an attempt to do right by me. Your reply is the first contact I have had with W4W this year.

As an employee of Warranties 4 Wheels I feel that I need to set the record
straight.

Capital Assurance has nothing to do with it. Doug Hartz is the deputy
receiver appointed by the South Carolina Department of Insurance to oversee
the rehabilitation of Ultimate Warranty Corporation. The information we were
given by Ultimate was not true. They misled us the same way they misled the
South Carolina Department of Insurance.

We have made over 50 phone calls to Ultimate, the Ohio Attorney General, the
South Carolina Department of Insurance, ARIC, and the Alabama Department of
Insurance. My boss has spent many hours on the phone with these people as well as our customers. He has never refused a call when he was available and always returned calls if he wasn't. We are doing everything humanly possible to see that everything gets taken care of the right way.

People here in the office have warranties with Ultimate Warranty Corporation. They were a great company for many years. In the past, you had claims that were taken care of, no problems. That being said, I am sure you got your money back out of the policy. Yet we still offer to replace the warranty with a different carrier, and we offer to do so at our cost. You make it sound like we tell you it isn't our fault and hang up the phone. The truth is that we care about our customers and we do go to bat for them.

I will let you in on everything that we know and what we are doing about it.

If you want to sue anybody these are the guys. Chief Executive Officer David A. Michael, Chief Operating Officer Michael L. Clark, and President Edwardo M. Jordan.

This is the point that we are at as a small business trying to protect ourselves and our customers.

There was supposed to be $48 million in a trust account and several times
South Carolina Department of Insurance asked for verification and never got it, but let them continue doing business. This dates back to 2004.

As of 10-15-2006 Assurant Warranty Services, the NEW insurance company that backed Ultimate, took over Ultimates book of business. We have documents proving that they accepted funds for contracts written with Ultimate. This information has been confirmed by MEPCO which is the company that finances contracts for Ultimate/Assurant. Our question to them is if they accepted the funds for the policies, how can they not accept responsibility for what has now happened. Assurant should be the ones that reimburse people for any and all claims until the expiration of each and every contract Ultimate has ever written.

As you can see we are looking into everything and doing the best that we can. I strongly believe that we are doing a lot more than most other companies would care to do.

My previous Toyota Camry went 270,000 miles and 13 years before it needed its first repair.... the diodes in the alternator died from recharging a battery I killed by leaving the lights on. This repair was a DIY job that cost me $115 and one hour including the trip to the auto parts store. How many months and miles was your warranty specified to last?

I don't know why people don't research their major purchases before they plunk their money down. Consumer Reports is available as a free read at many public libraries.
