If the vehicle was over 3 years old then selling you a warranty that is 36 Month/45K miles would make no sense if they were applying it to the original purchase.  But it makes even less sense(but apparently is possible) that they apply it to 3 years from the date of purchase of the warranty but still keep the original miles.

The real question you need to answer is what does the WRITTEN warranty that you have state.  Also, did they say you don't have a warranty(as in you never got one) or you had one and it expired?

You need to get all of your paperwork together.  Not only the original sales contract(that should show a warranty purchase), but a copy of the warranty.  As you need to read what the warranty says about how it calculates coverage in regards to mileage.    If you find out that they "sold" you a warranty but they never actually submitted the paperwork you have other issues with the dealer you are going to have to take care of.

That is how all "warranties" work (extended warranties are not really warranties at all, but insurance, but that's not important). The months of the warranty start when you buy it, the miles are not.  The "finance guy" you talk to after the sale of a car is almost always a scumbag, but this guy really takes the cake if he did as you said. When I buy a car I always make it clear that I will not even talk to the finance guy. FWIW, extended warranties are always a bad deal, even if they do give you some real  mileage with it. 

It is a 2006 Kia. If the warranty was 36 months from first purchase date they would have sold me an expired warranty, im pretty sure they cant do that. The guy failed to mention the 45000 mile part of the warranty. It seems as if half of the warranty applies to the original purchase (the milage) and half applies to my purchase date (36 months). It doesnt really make sense. I need to look into it more. They still screwed us out of the 10yr/100000 mi warranty they were offering on new and used kias since they "back their used vehicles also." I have contacted a local radio station I know played the advertisement and am waiting to hear back from them. I tried to search their september 2011 promotions and havent been able to find anything. We purchased the vehicle september, 23 2011.

My husband took the kia in for service because he heard a tick about a week ago. They informed him we do not have a warranty. So they sold me a 900 mile warranty.

Okay other than the Original Manufactureers warranty(if applicable) that does not get extended when you buy a used car, I have not seen one where they give you an additional amount of time but still apply the original mileage.  That is how I was reading the original post.  So I wonder what the "original purchase date" was and how many months of the 3 years was left as well as mileage.

When my husband took the vehicle in fir service last week due to a "tick" noise the dealership informed us we didn't have a warranty. So yeah we were screwed.

Robert, dealer do sell extended warranties on used cars that begin retroactive to the birth of the vehicle. It may not be the case with all such warranties, but has been for the ones I've been offered when shopping. My last used car had such a warranty, but it's age and mileage were low enough that it still made sense for me. In this customer's case, unless it was indeed starting from her point of sale, it would have been a total ripoff.

You really need to read the warranty because they apparently do it different ways.

We bought a used Millenia at 25,000 miles and bought a 75,000 mile warranty with it so we figured it would be covered until 100,000 miles. We were glad we did because the $5,000.00 Supercharger died at 50,000 miles and they replaced it with no hassle. 

Anyway, we found out later that the warranty actually expired at 75,000 miles so we really only had coverage for 50,000 miles.  When we read it carefully we found out they were correct.  The 75,000 miles meant the total car mileage and did not start from when we bought it.  The wording was not very clear either.  This warranty was a Mazda warranty and was sold through a Mazda dealer, not a fly by night outfit. Pretty disappointing.

The OP COULD be right, they should read it carefully. 

He informed us it was a 36 month warranty. He failed to mention it was a 36 mo/45000 mi warranty. The vehicle had 44109 miles when we bought it. If he had mentioned this he knew we would not of bought a warranty for 36 months or 900 miles!!
- Apparently you or your husband don't know that the 36 Month/ 45,000 miles STARTS when you bought the warranty.  So your warranty is good for 36 Months from the date you bought it, or an additional 45K miles.  So if you bought this car in 9/2011 it is good through either 9/2014 or 89,109 miles which ever occurs first.
