Upstate Management LLC Incredibly Hostile Debt Collection Practices and No Documentation to Support their Claims Buffalo, New York

Between 6/14 to 6/18 2012 I have received threatening phone calls from this company claiming that they will be sending me to court and demanding payment of a debt from over 2 years ago that I have not had any information on through mail or phone.

Immediately after being threatened to go to court, I contacted the Tulsa County Court and the Oklahoma City Court to see if I was on a docket and I was not.

I have not changed my phone number since I received it 3 years ago, and no one until not has contacted me about this issue.  I received a call from "Ron" at Upstate Management.  The first time he called it was a short voicemail stating his name, no information on the company and that if I did not contact him back by 5 PM I would be required in court on Tuesday 6/19/12.

The second time he called he left a more detailed message stating that I had a claim number and a pending item through a cash advance place.  I then called him back to find out what I could do to keep from being seen in court.  When I called him back he immediately stated to me that I owe over $700 dollars and when I realized what the original debt was for I notified him that the original debt was only $300 dollars.  I realize that I owed this money, but unfortunately I was never notified through mail or phone that I owed this money to the company.

I then explained to "Ron" that I wanted to set up a payment arrangement with them and was put on hold for a few moments and when he returned he promptly told me "No, the full payment or we will see you in court."  I realized that this was starting to sound fishy when they wouldn't even give me a payment arrangement so I promptly asked for all the documentation to be sent to me via certified mail that can be signed for and I can see the original documents.  He promptly told me "I won't be
doing that for you, the fact that we have not taken you to court yet is a courtesy to you."

After they refused to give me information I told them I would not be able to work with them until that information was given and the call was ended with "Well, I look forward to seeing you in court, and good luck to you then" and "Ron" disconnected the call.

Furious after this situation, I called back and asked for the company name and the address for the company and the person who answered the phone stated I was "threatening" him and proceeded to give me a lesson on "manners" and then hung the phone up on me.

My brother has also been receiving phone calls from this company as well as my roommate who was never on any applications or reference sheets for the debt I had, therefor it was illegal for them to contact those references if they had nothing to do with the original debt.

Wanted to report this company and see if we can get them for their harassing tactics.
