In October of 2008 Vanderbilt bought out the mortgage company we had and vanderbilt became a mortgage holder they raised our interest rate to 10.5 percent and our payments became $1425.00 a month about 7 months ago we were discharged from a chapter 13 bankruptcy at which time our lawyer informed us not to reaffirm with Vanderbilt so we did not but we continued to make our payments to vanderbilt on time every month. This month we are having a tough time my husband is self employed and his business has done nothing in the last two months so we are unable to make our payment this month we stared asking at the beginning of the month for our payment to be defferd till the end of the loan our payment was not late till the 15th of this month we have called everyday trying to get this tooken care of and they tell us each day give them one more day so a decision can be made on the account . we get alot of rude people that don't even try to help and being late on bills is not something we do every month this is infact the 1st late payment ever on our mortgage and they have some customer service rep.s telling us they will not help and start looking for another home we have reached out to everyone we can find for help and no one can help us this is our last resort for help please help us

I am sorry to tell you but your att screwed you. By not reaffirming you said you are no longer responsible for that debt but you may continue to live in that home as long as you pay (kind of like renting but with a mortgage). They can not really do much to change the terms since you decided not to reaffirm the contract. You can walk away and not be responsbile for the debt at any time and when it is paid off the home will be yours, but till then you are kinda like a renter, and non payment and you can loose the home. Your mortgage can not be modified either since you did not reaffirm. Sorry i do not have better news for you.
