After being a Wachovia customer for many years, they have finally decided to rip me off. They assessed $158 in overdraft fees to my account. This overdraft should not have occurred, since I used my check card as a credit card. So, the transaction that would have caused the overdraft would have been declined. However, they continued to assess additional fees.

If anyone is interested in further details, please see BBB Case # 406745

Additionally, if anyone is interested in taking legal action against Wachovia, please let me know.

This part of your report is confusing:

I don't see anything in the account agreement that says as debit card processed as a "Visa" or "Mastercard" will be denied. In fact, the agreement for my state says the opposite. What does the account agreement for your state say?

Whether you agree with their practice of resequencing or not, this situation was caused by your assumption that transactions that result in a negative balance would be denied. If you wish to avoid these fees in the future, keep a check register and don't authorize any transactions that will result in a negative balance.

Did you call Wachovia? You may be able to get one or two of those fees reversed if you haven't overdrafted in a while.

It doesn't matter whether you choose debit or credit when using a check card, it is always processed the same exact way.  Depending on your bank, it may be instant.  I don't work for the bank you are citing, but with the bank I work for I have purchased gas on the way to work and see it posted to my account by the time I get there.
