Wachovia Dealer services is trying to resell vehicle that we paid for. On December 11, 2008, The recovery service contacted me via cell phone to ask us to turn in our 2003 Toyota Taooma for non payment. We owed $3243 on the truck from a total of payments made of about $33,000.00. Due to economy crisis, my husband and I were strapped for cash and feeling the crunch. We voluntarily had them pick up the truck because we knew we were going to pay for the truck over the next couple of days. Well, Wachovia gave us 15 days.

Our due date was December 26. the day after christmas. They did not allow my bank to wire the money to them free of charge. I had to withdraw the money and go to a check cashing place to send the money via Western Union. All the while incurring more cost.

They had the truck at a location about an hour away from our residence. They moved the truck 5 hours away to an auction place in anticipation of selling the vehicle due to their assumption that we would not have the money on time. Their people on the phone were very rude and no one could tell us why they moved the truck so far away.

We are incurring costs daily at this location and they sent us a letter giving us until Jan. 31 to pick up the truck unless they would have to get a new release form.

M husband and I chartered the first bus out of NYC to get to Waverly, NY where the truck is being held on Jan. 31, the fee is now $911 and counting $10.00 a day. Any bus out of NYC gets you into Waverly NY at 3pm. We arrive upstate to find out that they are closed. They are open on Saturdays from 8am to 11am. The letter doesn't state their hours, and neither does anyone on the phone when we inquiry about coming to get our truck.

Wachovia sent us a letter in the mail saying that our loan has been paid, but they have yet to send the title.

We also received a call and a claim package from Hartford Insurance agency saying we filed a claim for an accident. We did no such thing. Wachovia fraudently filed a claim in our name. I contacted Hartford Insurance agency and left them a message. They have not returned my call as yet.

This is fraudulent practice and thievery and I want my truck and I'm going to take the necessary steps to get my truck back. I have made more than $33,000 in payments for my truck. Wachovia Dealers are trying to resell our truck.

Why would you allow them to do a voluntary repo when you knew you were going to pay(the paid off truck?) in the next couple of days?

- You supposedly paid for the car on 12/26 only to find out they already towed it to an auction yard 5 hours away, because that was the final day you had to pay. Yet it took you over 1 month to get the "first" bus out of NYC?

- Did you think.."Hey we are taking a 5 hour bus ride, perhaps I should actually ask what their hours are to be sure they are open?"

- Ummm..YOU told them to come and get the truck. So of course they are going to charge you towing and storage fees. Based on your report it does not sound like you were that anxious to get the truck back. On 12/11 you stated you were going to pay the truck in the next couple of days, yet since Wachovia gave you 15 days you took FULL advantage of that and didn't pay until the 15th day. Then you were given until 1/31(over a month) to go pick up the truck, yet you waited until the last day again...
