I made several small charges that were on my on-line statement that weren't posted for a couple of days. I then made a mistake and made a charge that created an overdraft. It wasn't posted until AFTER the small charges and at that time I still had a positive balance.

Wachovia deducted $175.00 from my account for overdraft fees. They claimed that all of the charges went through on the same day and the largest one took all of the money, so all of the smaller ones were overdrafts. This was not true. The dates were clearly on my on-line statement.

I called the bank and they told me I had 60 days to pay my balance. I had $200 in a different account for automatic bill pay and wachovia transferred that money to my account that was overdrafted, causing my electric bill to be returned.I visited the bank and they told me that they had a right to transfer my funds without my authorization.

I later called a manager in their customer service department. He credited $50 back to my account and said that the electric bill hadn't been posted, there was just a hold and if I made a deposit before 2PM that day, there would be no overdraft incurred.

I made the deposit, but the electric company was notified that there were insufficient funds and I was charged an overdraft fee. I was also charged $25.00 by the electric company. When I called customer service back they told me I was ineligible for any corrective action.

so what does that make the rest of us?

AUTHOR: Cat - (U.S.A.)

The majority of people here have no NSF charges at all and we understand how banks work. My husband asked and I asked many questions about the cutoff time for deposits, atm fees, bank NSF fees, how the charges are credited on the account, when we opened up our four accounts at our bank. No we do not work for the bank so we are not "one of them " as you so nicely worded it. We just understand how to add and subtract. Funny how 3rd grade math took care of those problems. We have never had bad checks and fees in the 27 yrs of our marriage.

If everthing sounds right, you are probably one of the ripoff artists.

The problem is not the overdraft charges. It is things being rearranged so the bank can suck a couple more ouces of blood out of you. READ THE POSTING! Most people understand that if you overdraft you get charged. The banks are taking advantage of people by manipulating chronology. The banks are getting more than they deserve. They get more than what they should by some very unethical behavior. Not too many people would get on here and say "I have a problem getting charged the fees I agreed to". They are mad because they are getting ripped off. If you think these fees are correct, you obviously are having a problem understanding what is being said, or you are one of the vampires.

Everything sounds right to me...

When you purchase something with your card whether it shows on the statement or not, banks place holds on the accounts for that amount so you DO NOT overdraft. Like someone already stated, banks go from largest to smallest for a simple reason, the larger ones are probably more important and need to be paid first as opposed to a $0.50 candy bar from Wal-Mart.

Once you do overdraft your account and the banks risk assessment for an individual is low enough, they may draw those funds from another account you have with them. The biggest thing is that it is listed in the packet of information when you open the account.

Now, with all of that out of the way, I know for a fact that if there was fraud on the account, Wachovia would lock the account. Once the account is locked, Wachovia conducts an investigation and in most circumstances the account number is changed and the fraud is returned. This occurs after the individual signs the affidavit stating the above is valid.

From what it sounds like to me, there is no problem here, just a disgruntled customer who believes if you spend more money than you actually have, there should be no penalty. This is not true, ALL banks have overdraft fees. What you should have done was linked the accounts so if it does overdraft and there is an enormous fee, you will instead pay a $10 transfer fee for EVERYTHING and there is no overdraft fee. This includes enough funds to cover the total overdraft not each individual one. So if you overdraft $100 from 5 purchases, you will pay $10 for $100 to transfer and not pay $175 overdraft fee.

The best advice I can give to you and anyone else no matter what bank you are with, keep a register and track it all manually. This way, you do not guess on the day it clears, you are already prepared for it.

Are you for real?

In the online system when items are posted and paid they will show for a previous days date. For instance if it was paid on 11/10/08, it will show for that days date, a description by it and a balance beside it also. What you may have seen was the debit pending with the date of the current day a description and processing beside it. This means it has not been paid. Also, if the items show that they are pending they have not been paid which means they can post in any order the bank wants them to. Your obligation is to have enough funds to cover all of your payments you have authorized. Until the items have been paid they can be charged a fee if your balance is not sufficient to cover the items when paid on the account.

What was fraudulent about the charges?

AUTHOR: Edgeman - (U.S.A.)

POSTED: Tuesday, November 11, 2008

You say that the overdraft charges were fraudulent, but you also say that you overdrafted your account. I'm not seeing how those charges were fraudulent.

Like most major banks, Wachovia processes transactions from largest to smallest in any given batch. You were probably expecting that the bank processes transactions in the order you make them.
