Long time favorite waitress of many regular customers, Tabitha J has been unfairly terminated from her job of over 10 years at Waffle House in Bremen, GA. Management there has falsely accused her of theft and suspicion of theft. As their reasoning,they say that because she makes mistakes on tickets from time to time, that she is stealing.

Of course these are not the real reasons. The real reasons are, bullying by management, favoritism toward their relatives that they have been staffing the restaurant with for some time now, now even one of their own relatives couldn't take the crap from management at this store and quit. Age discrimination is another factor, since Tabitha has been with the company for many years and they prefer younger individuals and or relatives. If you will notice, for the most part, the management prefers to hire younger individuals, but makes exceptions if the older individual is related to management. Not only is the practice unethical, it is also (illegal).

Some of those same relatives in question, can be caught red handed on surveillance camera, stealing other employees tips (multiple times), but still not be terminated for those actions.Normal employee don't get this same protection though. if they only "suspected" of theft, they are terminated.

1. I was not made aware of any missing ticket books by management. I am being falsely accused of misconduct. I feel the real reason for my termination is the management’s preference to replace older employees’ younger employees and persons related to management and retaliation for reporting other inappropriate actions to their corporate office.

2. I have worked for this company for more than 10 years and never had a problem concerning my handwriting until recently. The new manger would seem to have me believe, that I was suddenly stupid and incapable of writing proper tickets after 10 years of experience of writing said tickets.

3.  It is my contention that the real reasons for my termination were as follows.

   1.  New management wanted to replace older workers with younger ones and/or workers who were related to management. New management had sought to make me quit by making workplace conditions intolerable. I was constantly harassed and bullied by new management, work days changed without notice, job responsibilities changed without notice, false accusations constantly were made attributing wrong doing to me, where no proof was ever offered. When management was unable to force me to quit by making conditions intolerable, they made false accusations about missing ticket books and theft in order to justify firing me.

 The Age Discrimination in Employment Act of 1967 (ADEA)
This law protects people who are 40 or older from discrimination because of age. The law also makes it illegal to retaliate against a person because the person complained about discrimination, filed a charge of discrimination, or participated in an employment discrimination investigation or lawsuit.

  2.  As I stated above. I had worked for this company for more than 10 years at the same location. I never had any complaints concerning my handwriting in those previous years by any of the many other managers until recently when new management took over, I was suddenly being constantly harassed and it was obvious to me that the new management was trying to force me to resign. . New management would have me believe that I am suddenly stupid and cannot complete my job correctly after more than 10 years’ experience working for the same company.

 3. Management had been replacing workers with new employees who were related to them.  Employee who were related to the managers, were given preferential treatment over those who were not. One particular worker (Hilda) related to the district manager (Tabby Denney) was caught on camera stealing other employees tips off the table. She was not fired. Now they accusing me of “missing ticket books” and since I am not related I am falsely accused and terminated without any proof being offered.

 4. Retaliation by management.  Several months before my termination, I had to go to the doctor due to an infection on my thumb. I returned to work the and following morning I was told by the manager I could not return to work until I received written clearance from a doctor. I went back to the hospital and received said clearance from a medical professional and provided said written clearance to management.

Management refused to accept written clearance I provided them and refused to allow me to return to work. At this point I filed complaint with my employer’s (associate hotline). Only after filing the complaint was I allowed to return to work. Management’s harassment increased once I returned to work and they sought to terminate me in retaliation for reporting them. One of the mangers even said, “I don’t like snitches. I’ve never called corporate in my life” (April Waffle House manager) April also told customers and other employees that I was “highly contagious”. She spread rumors and seemed to know more about my condition than my attending physicians, who provided me written clearance to return to work. It was only after I made a compliant to the corporate office concerning management’s actions, that I was allowed to return to work.
