My friend worked at Wal Mart for 3 years, never took a day off for any reason accept her earned time off. She informed them she had to have a hysterectomy and a week later they said she couldn't do her job, and she was fired and lost all her insurance.

10 years is "Long Term." 3 years in the world of Wal-Mart is nothing in their eyes. I've been at it for 5, and I'm still pretty much a baby in their eyes... My Wal-Mart was built in 2000. I've been around 5 out of 7 yrs. I'm still a "hatchling" to the company, as we have some people in there who've been in the biz for 20+ years.

I do think it's completely wrong that they took her out of commission for medical reasons, but 3 years isn't really going to impress or alter their decision.

Three years IS a long time for a walmart employee. My wife worked for a local security credit union and they spent 8 months harassing her into quitting after sixteen years. THAT'S a long time to get dicked over.

It's called FMLA!

All your friend had to do was file for FMLA. That gives her protection under Federal Law while she gets her medical care. Her position, pay rate, and seniority is protected under Federal Law.

And, her insurance would remain in effect through the end of that months billing cycle sho she still could have used it, AND under Federal Law the employer must notify her with 14 days of the adverse action of her rights to continue her insurance under COBRA.

Too many things do not add up with this story.

Did she turn in a doctor's note. If she could not do her job usually they would try to offer another position, but since this is not worker's comp. they really don't have to. Something seems missing out of the whole story.
