My husband and I wanted to trade in our car to get a newer one. We only owed just under $1000.00 on ours and it is a 2005 so we knew we could use it for a good trade in. We went to West Valley auto plaza and at first they were very nice and seemed to want to help us. After a couple hours we went into the financing portion. We were going to be getting a 2011 Ford Fusion. They explained that we would be getting $4300 for a trade in value but needed cash in hand to help the deal go through easier.
We told them that we did not have it on hand and would have to wait until the following week. Our salesman said that we could come in then and pay it but they would need collateral to hold to make sure we came in and paid the $500. He further explained that it was to protect them on their side. I was reluctant but my husband said it sounded fair. After about another hour or so we went in to the finance guy to sign everything. We left and everything was okay. After a week we decided to bring the car back after discussing our finances.
It had been 8 days since we signed the paperwork and we had not recieved any phone calls from them about finding us financing. My husband goes in to get our old car and our collateral but was told that we could not get our collateral until we pay the $500. That is when they informed us that they use the collateral to pawn to APG financial and that we need to pay them to get our things. In my mind, if there is no finance deal with a bank then they should still have that $500 so why should we be responsible for it?
It is in our right to return the car if they have not found financing. Even if they had found financing we still have 14 days to rescind the contract. We are supposed to speak with our lawyer at the end of the week. I don't get why they are gephardt approved. After reading all of these reviews I can see that we are not the only ones who got lied to. If they had said that they pawned off our collateral then I never would have given it to them but they kept that portion out. Hmm, sounds like somebody just kept the down payment money.

The main thing to learn here is: Never take a car off the lot or leave yours until all financing and contracts are final, agreed to and signed. They will threaten you with losing that car. Walk out anyway. There are LOTS of cars, that's just another sleazy dealer tactic among many.
Just remember, they need you more than you need them. They are not the only dealer.

As soon as I posted this my Hunan checke the mail and there was a letter from West Valley auto plaza dated may17th, a day before we went in to return the car. The letter states that they could not find financing and that we had 14 days to return the car and receive any monies used as a down payment. Can anybody help us with this? All of this is smelling more and more fishy.
