First- a legitimate debt is owed by a family member.

This IS a collection agency.

With this said, they called on May 29, 2009 to the family member stating I was a cosigner on the note and told family member "if they didn't get the money from them, they would get it from" me.

I am NOT a cosigner but, a reference on the member's whereabouts and it so states on THE CONTRACT.

That is fraud #1.

The other fraud is that these folks are accepting payments for a period of time (this case 9 months) and then doing a refinance and selling the notes to someone unaware that the original person maybe of dubious ability to repay note. (specifically in this case person has been unemployed for over one year).

I got one of the several folks to acknowledge that they had lied as it was to "get the debtor off their duff" to pay the note. (other people there lied and said he never did anything wrong).

Be aware, I am paying them the token amount to keep them from harassing the family member. I hope that the people buying the note are notified of what they are doing so as to not to be sold worthless pieces of paper, such as was done in the housing market.

These folks were rude but, I think that comes with the territory of being a collection agent (I think it is a prerequisite), but, they also LIED.

Read everything they send you and DO NOT, depend on anything said on the phone (unless you record it), and then it might not be admissible in court.

I think you should check your credit report to be sure they are not listed. References for a loan are listed on the LOAN APPLICATION-not the actual loan contract. If you are listed on the loan contract, then it's very likely you are listed as a COSIGNER for the loan. You should read all the paperwork your family member has on this loan-carefully review the LOAN CONTRACT.

I have been purchasing new vehicles with financing since 1974 and no loan contract I've had EVER listed REFERENCES.
