WORLD SAVINGS HELOCS = Bad Faith and Breach of Fair Dealing, Fraudulent Lending/Biling/Payment Practices at World Savings San Antonio Texas

Because I have a first mortgage with WORLD SAVINGS, in September 2006, I contracted for a 2nd mortgage (HELOC) from World Savings. The first has always been paid timely via automatic payments from my checking account.

On the second / HELOC, World Savings has ignored 1st closing paper Authorization for Automatic Payment. They said there wasn't one. Loan has since always been one month in behind in payment. My statements for the World Savings HELOC have NOT stated that I'm one month behind - they state current, but have the $29.00 fee included. My World Savings Online statements state that LOAN IS UP TO DATE and has read LOAN IS UP TO DATE been since inception of the loan.

They have charged me every month $29.00 for late payments.

I've made payments to make up and World Savings arbitrary applies my payments so they do not make the HELOC account up-to-date. They pay principal down and not interest, vis-a-vie. I send the amounts on the statements that they say are due. I GO IN TO THE BRANCHES TO MAKE PAYMENTS: Branch World Savings Officers can only take payments. Montclair Branch officer called to get authorization to take my payment. They told her they would credit me the late fee - which she told me. They didn't and keep the loan on the Deliquent list. I went back to same Montclair World Saving Branch Agent, she remembered me and when she called in to get okay on my payment, she was shocked that they didn't do what they said they would do. She said somethings not right.

They will not take the loan off a delinquent list. In May, I again submitted another Authorization for Automatic Payment. I have the yellow customer's copy I received from the 1st Street, San Francisco WORLD SAVINGS branch. They did not process that because they said they couldn't read it. I can read my copy and everyone else can. Correct accounts, name etc. I have made numerous payment to make up for being 1 payment in the rears for the past now twelve months - with the instructions to apply payment to make up for missing payment and put the loan current.

On August 29, 2007 I wrote a letter, stating they payments were to be applied to catch up the loan and get me off the 1 month deliquency list. I enclosed two checks - one for the missing payment and one for the current statement. They cashed both checks. My 8/31/07 World Saving HELOC statement shows receipt of the full payment for 8/15 and 2 full payments for 8/30. My 8/31/2007 World Saving HELOC statement shows Oldest Payment Due Date of 8/15 with a Number of Payments Past Due at 1. With no total amount Past Due. There is no total amount set out in Total Past Due. And there is a Minimum aount Due of the same amount received on 8/15 - as reflected on this same statement.

Because this World Savings HELOC account has alway been a month past due - due to their not processing automatic payment authorizations and/or not applying my payment amounts from the current statement due amounts to the right ratios, or in a timely manner (they hold my payments in "Unapplied Funds" until I'm late again and they charge me $29.00. They lie and are incompetent. And because the payment is due on the 15th - I am always 30-days in the rears. And upon making a payment, if payment day is on a weekend or holiday - I am in the 33-day NOTICE OF DEFAULT range/ and notices I receive like clockwork, as I only have a couple day grace period because of their deceitful billing and payment practices. THIS HAS BEEN An undue hardship and total harassment - that World Savings won't correct. Phone conversations with their customer service agents do not listen nor do they help. One agent told me an amount due - I paid that amount over the phone. I called two days later to see if it go applied. Agent told me wrong I amount due that date - so on that call two days later to see if payment had been properly applied, I learned I was told $10.01 too less, making the amount not paid in full, thus another $29.00 fee for late fee. Next phone call agent gave me 3-months adjustments in late fee charges. The payment before that, they put the amount received in their Unapplied Funds column and did not apply it to my loan payment.

This has to stop. I MAKE MY AMOUNTS DUE, DUE IN THE REARS AND WORLD REFUSES TO MAKE MY HELOC LOAN CURRENT. They need their loans investigated. For incompetence, or corrupted billing practices. Negligence in not having their paper statements reflect their online banking statements. I never had a problem with World Savings until - WACHOVIA took over World Savings last year.

And I have huge closing costs on the first. Also my first "INDEX" just changed - Wachovia just changed the index, so they now make more money and the ARM is skyrocketing. These mortgage banks are ruining my credit, my health and my faith in the corrupt American System.
