YES ENERGY MANAGEMENT Illegal late fees, bogus late fees, charging late fees on top of late fees, violating ca usury laws, harassment Colorado Springs Colorado

I have called this "company" SEVEN times regarding their illegal activity. I have never been late on my bill. Sometime in December 2016- January 2017 YES energy management company cashed my check almost 16 days after it was mailed, then slapped an ILLEGAL $9 late fee on that bill, which I have not paid and will not pay as this violates usury laws. Then, each month since they charge me a late fee on that $9. On my 3rd and 4th phone calls I was told the late fees would be removed. I looked at my bill and "3 late fees reversed for 2017". On the SAME EXACT bill they then charge me another ILLEGAL late fee of $4.98. I have deducted the $13.98. I have never been late, these fees are becoming harassment, I will be suing for their actions if this is not rectified once and for all.  In addition to damages, I will be suing for attorneys fees, statutory damages and punitive damages for the harassment and distress you have caused. Not to mention what a waste of my time. You will be hearing from my attorney if this persists and I am suing you for all my out of pocket expenses as a result of THEIR ILLEGAL ACTIONS. Additionally I will be filing a complaint with the public utilities commission and posting your company on ripoffreport.com along with other websites to start a class action lawsuit.

California Law CLEARLY states:

ANNUAL MAXIUM INTEREST AND LATE FEES IN CA:

Loan/forbearance of any money, goods, or things in action, or accounts after demand-7% or contract rate (Const. XV §1) contract rate shall not exceed 12% (Civil Code §1916-1)
Contract or agreement for greater than 12% shall be null and void as to any agreement to pay interest (Civil Code §1916-2); debtor may recover treble amount paid; willful violation-guilty of loan-sharking, a felony and punishable by imprisonment in state prison for not more than 5 yrs. or county jail for not more than 1 yr. (Civil Code §1916-3)

Today I received another "urgent notice" claiming a $.70 cent late fee has been assessed.
