I had an auto accident in June in Ridgeland, MS. AIG's client was 100% at fault as she hit the rear of my car while I was waiting for a red light.
Though AIG paid for the car repair, rental, and $1400 in medical, their "pain and suffering" offer was only $1400. I had two sets of xrays taken, was on pain meds for almost a month, and had chiropractic care three times a week for a month. Since AIG's claim adjustor was so difficult, I filed a Med Pay claim with my insurance company so I could get treated by the hospital and chiropractor. AIG reluctantly paid the medical bills after I told the claim adjustor there was a med pay claim filed.
But what's the price of pain? What dollar value can you put on waking up at 2 am in severe agony? What is the amount of suffering when I crawled out of bed almost every morning?
AIG offered $1400. I rejected it politely. But now what? I do not want to go through a lawsuit; I feel this can be settled quietly and civilly. Yet, I have never been in this situation before. How do I get a better deal w/o attorneys? Anyone have any suggestions?

I accepted their offer. Getting an attorney would prolong this claim for weeks or months..and for what? Another $500 or $1000? I felt that I already won, since they are willing to settle. So did I want to be right or did I want to be happy?
I chose to be happy, take the free money, and be done with this episode.

If you feel you deserve more, hire an attorney.
I just settled with Allstate for an accident that occured in January for which their insured was 100 percent at fault. Since I have an attorney, I immediately got him involved. I just settled last week. Though it was for less than I was asking, it likely was more than what I could've gotten by myself, and the good thing is that I didn't have to talk to the adjuster ever -- not once.
