I just recently received a Court Summons from "Ewing & Ewing Attorneys, P.C.(from Calvary) on 01/26/2010. He told me specifically, to write a letter to the address **** E. Cotton Center Blvd. Suite **... and that is all I had to do. I never signed anything or got proof of who the person was in front of me(even though he stated himself as "a Sheriff", but he was in normal clothing not showing me a badge or ID). To be quite honest I was more in shock of what was going on because this would be my first court appearance. No court date or court information was listed. The Summons was signed and sealed by 01/12/2010, signed by a judge that i cross referenced to be legit.
It is showing a past credit card from a Chase Bank debt that was obviously bought out by this debt collecting company with original charges of $2,947.04(a $2,000 credit limit card). The interest(24%) over the last few years has increased it to 4,375.18 from 12/31/2007 to 01/06/2010. I think those charges are unfair but from what I understand 100% legal. The Creditor who purchased the wrights goes unnamed on the summons.
"You are hereby summoned and required to appear and defend, within the time applicable, in this court. You shall appear and defend within 20 days after the service of the summons and complaint upon you, exclusive of the day of service" - By this I assume that since i was served on the 26th that 20 days or later there will be court but no such court date is filled. I checked online with the North Valley Justice Court and tomorrow I am going to contact them by phone. When I went to the Court website... there is a new case filled out, but appears to be in limbo with nothing on the case calender.
This report is still early in the process, but I do need the advice. If they do end up going after me for that amount, unfortunately I must file for Chapter 7 Bankruptcy. So I am looking at $4,375.18 in the charges against, not including court & attorney legal fees. I am currently employed but have been struggling for a "decent paying" job in the past few years and it is not getting any easier.
It looks to me like they filled out a claim to try and get me scared and contact them. But is this a threat to settle out of court, or do they intend to make this all the way through court system?

You have been sued by this collection agency. you will need to show up in court or they will get a judgement against you by default.
When they win the suit (and they will by the way), if you live in a state where wage garnshments are legal, they will garnish your wages, and empty out your bank account.
If you file chapter 7 bankruptcy, remember you must pass the means test. This is very hard to do now adays. If after paying your essential bills, and secured debt payment, and you have ANY money left over, then you have failed the means test.
You will be forced to file Chapter 13. This will take all of your unsecured debts, and place them in a pool, and the creditor will take any $$$ you have left over after paying your essential bills, and secured debts, and divide them equally among all the unsecured creditors for the next 5 years.
Essential bills are considered to be Rent, Utilities, Health Insurance Premiums, gasoline, food, clothing. But remember the amount that the government allocates for these amounts vary from region to region.
Google Chapter 7 Means Test, they have calculators on line to determine if you qualify for chapter 7 bankruptcy.
