I got a chase auto loan in August 2005 two week before hurricane Katrina. They allowed me to defer my first payment until December 2005 because of the storm. I had not gone back to work until March 2006 and all this time been making timely payments never late.

Now fast forward two and a half years later. I was late in October paid that payment in November. In December 2007 Chase repo guy came to my mother's house looking for the car and asked where he can find the car because they wanted their car. I stated to him that I was not even three months late and I was only one month behind. He stated that I was 41 days late and they needed the car. WOW!! I said.

On December 29, 2007 they got my car in the state of North Carolina (a day after my birthday might I add) the repo guy was so rude and drove off while I was trying to get my belongings out the car. Now after speaking with chase on January 2, 2008 I was told because she did not like my answers and probably my attitude she did not feel comfortable giving me my car back. She also was very rude and had major attitude with me.

Later that day the representative calls back and stated after speaking with her manager if I wanted my car I had to pay off my car for a total of 6,000. Now I just called the tow service that towed my car to get the rest of my personal belongings and was told that they took my belongings out of my car and shipped it to auction. I was also told by the tow service that chase only gives you three days to remove any personal items left in the car (did not know that and was not told that) when I asked Chase for their number on December 31, 2007 I was told no.

On yesterday I received a letter from Chase with a breakdown on my payoff and that I had until January 15, 2008 to pay them or my car will be auctioned at a private auction. Now I am no dummy but how can I get my car if it went to auction already.

WOW I can't believe what is happening to me.all this for being 51 days late on a car loan.

that Chase employees respond to only targeted complaints on here, and also only respond to portions of the complaints.  I have seen reports on this website of ridiculously unethical and credit damaging actions by Chase but not one employee has attempted to defend any of those.  In addition, what about all the lies and the runaround given to the consumers?  Yes, consumer may have been late but that doesn't justify the rudeness and the misleading information by all parties.  I can't wait until this company folds.

You need an attorney

Technically, a lender can repossess if you are only one day late. Very few will do this. They just want the money for the car. Consult with an attorney. The collectors will very likely be torturing you for a deficiency judgement. If Chase did not follow the laws for your state, Chase may have lost rights to a deficiency judgement. Ignore Chase employees. I have found them to be an ignorant group, and they keep inaccurate payment records. I'm hoping that they do to me what has been done to others. I would love to file suit against Chase for repossessing a paid-for vehicle.

Where in your mind is being 51 days late on your car payment ok? I'm sorry but if you're that delinquent on your payments it's obvious you cannot afford the payments and therefore the car dealing with your current situation. You should expect Chase to repossess your car, your driving it around running miles on it, lowering the value of OUR car AND you're not being paying for it...amazing!!! How is Chase benefiting from letting you keep our car. We're not a non-profit organization, we're a bank here to make money and we took a chance giving you a car loan to begin with when no other lender wanted to. You should be lucky you were able to keep the car that long before it got repossessed.

You were not ripped off

First of all there is no law that requires a car loan to be 3 months late before it is Repoed. As soon as you are 30 days late you are in default, and your car can be taken back. Now, it is true that most companies do not want to repo every car that is 30 days late but it is their option to do so.

There is also no law that says they have to give you your car back under the same terms. So they were well within their rights to what is know as "call" the loan, and require payment in full.

As for the Repo guy and Chase being rude. I am sure that you probably were not the nicest person at the time either. After all they took your car when you feel they should not have, even though you were delinquent.

The best thing for you to do is find out about filing a claim for your personal property. Then call Chase ASAP if you want to pay the balance. If you don't want to pay the balance find out the auction date. It is doubtful that it was 1/15, but it probably will be soon. Then go to the auction and buy back your vehicle.

You don't have to be 3 months behind in order to a finance company to repo your car. They can repo if you are late any amount of days. If you were paying late and maybe not keeping in contact with them then they may have assumed that you were going to disappear with the car.
Also, once the vehicle is auctioned off, you become responsible for any of the original loan amount that they were not paid by the auction.
