I have been working with EMC Mortgage corp on a mortgage modification for 16 months now with no resolution.  When I first applied for the MHA modification I was not even one payment behind.  I told them that I would soon be unable to make the payments because my financial situation had changed dramatically.  I finally missed one payment.  They have requested documents over and over again.  In January, 2010 they put me on a trial payment plan never telling me that the difference between the original payment and the trial payment would put me further in arrears.  I have been on that trial plan for 10 months now and their nasty customer service reps are telling me that they no longer have to accept my trial payments because the trial should only be for 3 or 4 months.   I'm only still on it because of their unwillingness to work on my file!  Then they told me to try to pay more than the trial amount, but I was advised by a HUD Housing Counselor that that would void the trial payment amount, so I shouldn't do it.  At the end of April, 2010, after waiting for over 8 months, they told me that the government had changed all of the rules regarding the MHA and that I would have to begin all over again.  They had me submit the entire packet of information again.  Since that time, I have been told that my file is being "escalated" every other week.  Then they tell me that they need new paperwork.  Then then tell me that it has to go to a relations manager to review before it can go to an underwriter.  Then then tell me it is with a relations manager.  The next week they tell me it's not with a relations manager. Then I need new paperwork, and so on and so on.  It's always a different story.  Finally one of the reps told me that it had gone to a "junior underwriter" by the name of Maria Vu.  The next time I called I was told that there was no such person and that someone made the name up.  They said that it came from the initials MVU which stood for Mortgage Verification Unit.  The next time they said it really was a person, and gave me her direct phone number.  I have called that number steadily for almost 4 weeks now and always get voice mail, always leave a message, but MVU never calls me back.  Then a rep gave me the name and number of someone who was supposedly MVU's supervisor.  Same story,  many calls, always voice mail, never a call back.  Several of my phone conversations with EMC have even been conference calls made by my HUD counselor, and even then we get nowhere.  Then a few days ago, one of the reps told the HUD counselor and myself that my modification had been declined "Long Ago".  No, he couldn't tell us why because all they see in their computer is a code.  I never received any notification to that effect, and every week they tell me they are still working on it.  And, NO, there was no one he could transfer us to so we could get the information.  Then a rep said that it could not proceed probably because some paperwork was not in order.  There was apparently something for me to fill in on that paper, however,  each time I had to submit that particular paper, (which was a total of 4 times so far)  I was told to just sign and date it and that was all that was needed.  I am terrified that, because of their incompetent business practices, I'm going to lose my home.  I have no where else to go and have worked deligently with EMC to correct my mortgage situation, but they misrepresent everything always.  Please someone start a Class Action Suit against this company.  And please MR. OBAMA do something to hold a company like this liable for what they do to people.  Someone HELP
