In 2005, Jackson Hewitt made a gross error in taxes, and wouldn't you know, it was the same year they did away with the Gold Guarantee that protects tax payers from their inadequacies. For this year alone, our amount that we owe because of an audit, which when other preparers look at is can plainly see their error, is costing us over $2000.00.

For 2004, still not sure what this one will cost us, and for 2006, at least $800.00. I can't believe there are companies out there that will blatantly make an extreme error such as claiming we own a company vehicle, when we didn't own it the previous year, and still worked for the same company. For 2004, they claimed me as Head of Household, when I have never ever filed that way, always injured spouse. Of which I am. We had another one of their preparers look at it after getting notification of the audit, and they found the error right away, plain as day.

I can't believe that they aren't responsible for something they obviously did, and was even told by the auditor that they have been having many problems with their company. Not showing up for the meetings that they set, trying to back their way out of paying for their obvious and extreme errors, can a company really operate like this legally?

Suggestions - If they were negligent in filing your tax returns you can take them to small claims court.

90% of the people who work for any tax preparation company have very little training(as compared to an actual Tax Accountant or CPA). They can handle the basic returns, but if you have anything unique you may be fine but you also may have issues.

If they were negligent in filing your tax returns you can take them to small claims court. This will not get you out of the tax you owe, because if they filed it correctly in the beginning you would have owed that anyways. But you could make a claim against them for any penalties and interest.

However, you have to be able to prove that you gave them all of the information they needed. If you withheld(even accidentally) paperwork that would have caused them to file differently you will not prevail.

Other things to think about. Before your taxes are filed you can review your forms. It seems that you knew how you filed before, so did you question these things when you filed?
