Recently I joined LA fitness (Aug. 10, 2008) with the confirmation that when my company bought a policy with the fitness corporation, I would be refunded my $75 application fee. I have a witness for every time I inquired and a general manager's (Ruben Michel) approval that no matter what timeline, as long as it was before year's end, I would be awarded this refund. I went in to honor this refund policy with a voucher from my company on Oct. 11, 2008. I was informed by the night manager Sam, I would not get my money back since I was 1 day outside the 60 day window. Then he stated he could not do this because I joined at another club 10 miles down the road. Then, after being pushed why, he stated he could actually do it but again only if it was in the 60-day window. He then re-iterated, despite the fact I was on business travel until Oct. 11th AND out of the country at that, now no one can do it again because I was ONE day late AND that I was previously lied to by 2 membership sales people and the General Manager of the Tucson club he currently working at in Arizona. This is the worst display of customer commitment and basic bait and switch. I would highly recommend NO ONE ever join LA fitness with any verbal commitment from any, and I mean ANY member of the staff. The only people willing to work with you seem to be the (((Redacted))) membership staff. I have never meant such a dishonest organization in my lifeas LA Fitness. Please don't believe any verbal commitment you receive from this company.

That's all that really matters here. If you came in on Day 61, then the folks at the fitness club are correct and you're not entitled to the refund, no matter the story they tell you. Never count on a verbal promise one way or the other; the writing is what matters. If the matter in the written contract is silent on a refund, then there would not be a refund in any case. If the number of days is silent, but the refund offer is in writing, you may have a chance at a refund. Best of luck to you.....

Never take an employee's verbal statement at face value. You are obligated by the written contract. You signed the contract, you are responsible. If you did not read the written contract then possible problems may be the fault of you the customer.
