XXXX XXXXXXXXX: hello Faye: Please wait while I check that for you XXXX XXXXXXXXX: whats odd is i dont even see the phone on my account... Faye: Agreement Number 4. What Is Free and What is Not: Faye: "We may require prepaid purchase and/or we may charge you for calls to conference lines, platforms and certain non-ILEC area calls, or any call wherein we incur a cost from another carrier."
Faye: magicJack completes calls to conference lines, platforms and certain non-ILEC area calls in conjunction with large phone carriers and these calls require a prepaid purchase. Please know that these rates are at a substantial discount to Verizon rates and the other largest carriers and are the wholesale rates of the largest carrier.
XXXX XXXXXXXXX: um... i have a magicjackplus unit with number porting XXXX XXXXXXXXX: prepaid. Faye: No, this refers to conference lines, platforms and certain non-ILEC area calls, or any call wherein we incur a cost from another carrier."
XXXX XXXXXXXXX: so... i can not call a neighboring town? XXXX XXXXXXXXX: and i cant call my mom's town? XXXX XXXXXXXXX: of whom i always have in the past? Faye: Nothing to worry, all you have to do is purchase IPP minutes for that Faye: We may require prepaid purchase and/or we may charge you for calls to conference lines, platforms and certain non-ILEC area calls, or any call wherein we incur a cost from another carrier. We may provide for a fee, premium prepaid services, which may be powered by YMAX Communications Corp. (YMAX), and may include some inbound, international, conference, platform and outbound calls that receive a recording and certain calls to non-ILEC areas, and the rates for those services will be governed by listed price lists or tariffs. XXXX XXXXXXXXX: i never had to prepay for them before now? aka, i have called them in the past on magicjack? Faye: I understand that XXXX. XXXX XXXXXXXXX: when did this change occur? XXXX XXXXXXXXX: aka, i need to warn others that I have recommended this service to XXXX XXXXXXXXX: and can you tell me the charge to 1 507-896-5323 Faye: Please click here for TOS and read agreement number 4 XXXX XXXXXXXXX: can you tell me the rate to the above number? 5cents a minute? $5 a minute? Faye: You can hear voice message for the remaining balance you have. We don't have exact rate for that, it depends with the number you're calling XXXX XXXXXXXXX: ugh.. so i will never know. XXXX XXXXXXXXX: houston mn sucks.. private exchange. XXXX XXXXXXXXX: aka, thats the phone location i am trying to call. Faye: Nothing to worry, you can check the remaining balance you have from your magicjack account so that you'll know the charge per minute XXXX XXXXXXXXX: so is it ace telecom charging for that?
XXXX XXXXXXXXX: LOL.. because we were testin the phone, now we are getting calls.. i guess i will just need to use my cell more.
_________________________________________________________-
after the first call, i got on another conversation, but lost internet connection and did not get a transcript...
Asked how much the charge was per minute.. was told that it was typically $2 a minute....
They advertise free calls the the US, yet after the 1st year and a renewed contract, charged for the exact same calls? isn't this called false advertising?

Nice fast reply..But.....

I included a snapshot snippit of their screen on my first posting... no where is there an asterix.... ANYWHERE on their site. My purpose of my report is not to whine about my not reading their TOS agreement.. just a warning to people to READ the TOS and to UNDERSTAND what they are able to do...and not do.
Their Terms of Service is available here: http://www.magicjack.com/plus-v05/tos.html
and in a nutshell:
Line item 4 states they can charge for ANY call they wish.. I was calling a number at a traditional telephone company that has expanded to internet and cable tv as well.
No where on their site do they list rates, nor do they give clear replies on how much it is going to cost.. other than... pay, make a call, then check your account for how much it has dropped.
Even skype (http://www.skype.com/en/rates/) allows and clearly states that prepaid is at 2.3 cents per minute with a 5 cent connection fee. - significantly less than $2 a minute.
Line item 13
13. Modification
magicJack, LP and/or magicJack VocalTec, Ltd. reserve the right to modify or discontinue the magicJack and/or magicJack Plus device, magicJack APP and Software, temporarily or permanently, with or without notice to you. YMax reserves the right to modify or discontinue its services, temporarily or permanently, with or without notice to you. We will not be liable to you or anyone else in the event that we exercise our right to modify or discontinue the magicJack and/or magicJack Plus device, magicJack APP or Software and/or YMax services
Basically states that they do NOT need to comply with ANYTHING.. they can rewrite their contracts at will and do NOT have to inform their clients of the changes.
As stated, buyer beware and READ the fine print.
I will give them credit.. for most calls, the unit is well worth the money.. Just have a backup plan in place when it doesn't work.
*I apologize on the original post.. I was quite frustrated when I was entering the original information. I *still* feel that it was a bait-n-switch, but as the rebuttal states, for $40 a year, what does one expect. (the plus service and number porting makes it more costly)

Actually its not false advertising. You just didnt fully read the T&C. Im also betting that there is a asterix next to that phrase. That asterix is what protects them from false advertising suits. If you simply took the statement as is on its face, without fully reading the T&C, then you would be able to assume that it was false advertising.
See in our quest to either save money or just not spend it, we tend to make assumptions from the information presented to us. This is our faults as consumers. We tend to take EVERYTHING at face value. The reality is that once we as consumers have made the assumption that the statement provided to us is gospel, we tend to fight and argue against anyone telling us differently. You cant blame MJ for what is in essence a failing on your part.
Had you done your due diligance in your reaserch you would have found the information the rep had provided to you. There would also be a provision stateing that each time you resign with MJ your services and features can change without notice for whatever reason the ppl at MJ say.
Its unfortunate that MJ isnt meeting your needs. However, for 19.99 a YEAR they make a excellent local phone provider. Keep useing them as such and just use your cellphone for long distance until you get out of contract with them.
