Judge Enters Permanent Injunction Against Turley-Thompson and Treehouse Marketing to Stop Confusing Sales Practices SALT LAKE CITY, Apr. 22 /PRNewswire/ -- SALT LAKE CITY, April 22 /PRNewswire/ -- Basic Research LLC received a favorable ruling in the lawsuit filed in Salt Lake County District Court seeking an injunction against Turley-Thompson LLC (d.b.a. Treehouse Marketing) for using advertising materials that infringe on Basic Research's trademarks, trade names and trade dress in its marketing efforts to consumers. Basic Research's complaint alleged that Treehouse Marketing repeatedly used Basic Research's trade dress elements to its own benefit, and misrepresented its relationship with Basic Research in an attempt to confuse customers. In granting Basic Research's motion for a permanent injunction, the Court found that the improper conduct by Treehouse was likely to cause confusion "among consumers of nutritional, health related and cosmetic products." The Court also permanently enjoined Treehouse Marketing and Turley-Thompson from using in any way Basic Research's "trademarks, trade names, trade dress, Trade Dress Elements, or any confusingly similar imitations." Further, the Court granted Treehouse Marketing sixty (60) days following the date of the Consent Order to liquidate existing products at "usual and customary prices." During the Liquidation Period, Treehouse Marketing may not use any trade dress or Trade Dress Elements that are subject to the Consent Order. Those 60 days ended on April 11, 2003. The Court entered a permanent injunction that prohibits, among other things, Treehouse Marketing from "stating or suggesting to third parties that Treehouse Marketing is "in any way associated with or affiliated with" Basic Research. Basic Research indicated that it will not allow the use of Basic Research's good name, trademarks and Trade Dress Elements in conjunction with unfair and confusing sales practices. Basic Research will take aggressive action against companies that inaccurately portray their relationship with Basic Research and its products.
