In 2002 my grandmother passed away, My grandfather and her had death insurance, My grandfather after the death of his wife moved back to Ky with his mother leaving the home to My girlfriend and my 2 children and I.We begain to send in his payments,(that Vanderbilt Mortgage And Finance claimed was due).

they then started sending letters saying that they had not been getting the payments. We paid by us postal money orders, they were claiming that they had not been paid in three months. we told them that they needed to check there files , that there was death insurance on the trailer. A Mr Hood told me that it was not up to his company to produce such a document and that the payments were due and had not been paid.

so we had the post office do a search on the three money orders. after a week or two we got the search back each of the three money orders had been deposited in a general found belonging to Vanderbilt Mortgage And Finance with there stamp on them.the still denied having the money even after I faxed the search to Mr hood he said it is not his problem and they had not been posted to the account, Mr Hood denied getting the fax.

Knowing that the insurance was infact there we stopped payment from that point on. they kept calling saying the were going to foreclose. they started calling my sick grandfather with a weak heart 5-9 times a week, telling him that he was in default and the were going to foreclose. this they did after about a year they went to court without us being given notice gained judgement, we were woken to a sheriff one morning telling us we had four days to move out,

Me being disabled and two young children in the home had no idea what to do, we were blown away. they made us move we were forced to sign a one year lease on a house (rental) at $700.00 a month being all we could find with short notice. ( this house will be my next report). they sold our home last month. Now for the good part. the insurance company just sent us a letter ready to make the insurace claim good. OOOPsie!

We will soon be in court for the money owed to us. any information is welcome to help me get justice for the hardship and pain the have caused my family with the theaft of our home and money. repayment for this dump we now live in. the many many things we lost. my grandfather is not expected to make it much longer. But they will NEVER get away with this. they failed to tell the courts that my grandfather had insurance on him and his wife THREW one of Vanderbilt Mortgage And Finance Insurance companies.

They seem to always win

Maybe if we all got together against Vanderbilt
and Clayton Homes a judge would listen. We need
to get more media involved till someone hears our horrifying situations. Maybe then we could
prevent it from happening to someone else.

Until we all work together, I believe they will always win.

Maybe the attorney Josh in Knoxville would file a class action law suit for all of us. Until our day comes..try to live without the undue stress even though it is tough.

God Bless You All

As much as I truly hate hearing your plight, based only on what you have written here, you are going to surely lose.

"Knowing that the insurance was infact there we stopped payment from that point on."
Big mistake. Strike one.

"they kept calling saying the were going to foreclose."
And you ignored them. It's called "fair warning" and you failed to respond. Strike two.

"telling him that he was in default and the were going to foreclose. this they did after about a year"
A year? Are you serious? They gave you time to respond. Strike three.

"Now for the good part. the insurance company just sent us a letter ready to make the insurace claim good. OOOPsie!"
OOOPsie indeed. There is NO "good part" !!! If they are only NOW "ready to make the insurace claim good" that means that they did NOT pay the claim initially, the mortgage company did NOT get their money that was due them, and you defaulted. Period. Furthermore, the actions you describe above only nailed you even worse when you intentionally ignored their correspondence.

Again, I'm very sorry to hear the story, but at this point it appears to be totally your own fault. Good luck!
