We started having problems from the very beginning of our ordeal. The people who have their home financed with Vanderbilt are deceased, which is my mother n law and her husband. My husband is the executor of the estate. We have had to endure many rude phone calls over the past two years. In the middle of acquiring this estate, my husband was deployed to the Middle East.
We continued to make the payments while he was deployed and all the while he was gone they continued to call and harrass all of the family members they could find numbers for to include myself, my husband's brother, and my father who has nothing to do with this estate what so ever. They also called my minor child and yelled at him and called him a liar. Then to make matters worst they sent a representative to our personal home in WA state to take our home. The house they have financed is in Texas. In the meantime we have told them endless times we have a buyer for it, and is being sold through a reputable realtor. It is due to close in the middle of July. Sadly the soldiers sailor relief act doesn't cover this estate. Only personal finance of soldiers. They continue to call my husband at his job and we had to have caller ID put in so we could avoid answering the phone.

Dear Lora, I'm interested to know whether or not you were able to get the mobile home sold? We were never successful as we were not able to get a Realator. The mortgage holder had refused to give a pay- off. At one point, I recieved a call from a potential buyer who told me that they (the buyer) was informed the pay off was $30,000 more than was actually owed but, "to stop into the sales lot and take a look at the brand new line of homes." 13% interest is a pretty good reason to hold onto a loan.
Did you have any problems at closing? Is Vanderbilt still harrassing you? Did you end up going through an attorney? I discovered that most of the big law firms in most of the major cities across the U.S. is on retainer for Bershire Hathaway/Vanderbilt. I do hope you were able to find some resolution and were able to finally settle the estate.

If I were you, I would tell them you are selling the home and when you are closing. They want the home paid off, they dont want to repo the home. It would not be worth it for them to pursue foreclosure when they can get a payoff soon, just make sure you give them all the correct information and also contact information to your real estate broker.

I thought of going to JAG but didn't think they could help us, but you brought up a good point. The person listed on the estate is a reservist and is home now, but he is also a federal employee. Thank you for your comment and suggestion.
Sad thing is we have a buyer for that house and it is in the middle of being sold, I just fear Vanderbilt will hold no punches and hold up the sale.
I have contacted an attorney and will be meeting him in the near future to search out our legal rights. Thank you for your suggestions, as I read all of the complaints they all mirror our same situation.
The biggest complaint we have is Vanderbilt is treating this as if it were our own home and loan, we had nothing to do with the home loan. It's just part of an estate that didn't get settled before going to the Middle East due to time constraints.
I worry about my brother n law that was put on the contract as a contact person. He didn't know he had been put on it until after the owners were deceased.

Don't stop there. You also need to contact the State Attorney Generals Office in Washington, Tennessee and Texas. File complaints with all offices and make sure that his chain of command is briefed on the situation. Military pay is an easy target for Vanderbilt, especially if your spouse's job requires a security clearance.
