Some things that make me believe he is in breach of his fiduciary duties:

1. falsely promised my dad that the number he wanted to sell at would be outbid and to not list it at the higher price my dad wanted...10 days in, tried to pressure him to sell on the first lowball offer (lower than what my dad got on his own as fsbo during off-season).

2. told my dad it is unsellable, and doesnt want anything to do with us (blocked all contact), but also says we are obligated until the expiration. basically keeping my dad hostage. like if you dont want anything to do with us, then release us... instead he is demanding $1500 for doing absolutely nothing.

3. used our own resources (previous photos), had us do showings instead of him, when asked for a drone shot he got a screenshot from google maps.  kept making excuses that he had a colonoscopy, and then it got rescheduled.

4. he said he would release my dad multiple times, but refuses to send or sign a release from exclusivity form.

instead, he tried to trick my dad continuously, saying that the withdrawal from mls form would release us from the obligation. the mls legal support said those two are mutually exclusive. the gaslighting has been done entirely through text.

5. falsely claimed to police that my dad stole his property, when in fact it was a gift he gave after he signed (a better version of my dad's shoecover despenser). he also claimed my dad threatened him with violence when my dad said he would not be ok with seeing him on our property.  imagine a broker sending police over to your house instead of just releasing you from a contract.

we already filed an ethics complaint. and will do one with the department of state

thank god we got him to sign 90 days and not 6 months...if you work with this guy, get him to do it for less than 30 since he thinks houses should sell right away.
